Keeping it brief..
Got PCN from Smart parking - was to son as I was driving his car. My son/partner worry about this sort of stuff so agreed for him to tell them I was the driver so that I could deal with it.
Original PCN had entry time at 20:57 and exit at 21:07 - 10 mins as per Ts and Cs. Transpires (following initial appeal) I was 20 seconds over so was actually parked for 10:20.
Further appeals through IAS (I know, waste of time) and subsequent letters coming through from Debt Recovery Plus (recent one gives me a final, final option).
My question is - technically I was over the 10 mins "allowed" - if they do decide to goto court, am I likely to win?

They may not take it to a hearing in court, you are assuming a scenario that they don't tend to do
If it did go as far as a hearing, only a foolish person would try to predict any outcome, either way, so I definitely wont attempt to prejudge a judges independent decision
To answer your thread title, you ignore the letters with no consequences, but not a Letter of Claim, or a Money Claim
Not all Money Claims get to a hearing, quite the opposite, we tend to see a discontinuation just before the court hearing fee must be paid for by the claimant or their lawyers1 -
Is it not a minimum of 10mins allowed2
-
A typical CONSIDERATION period is currently 5 minutes, but check the annex in the joint code of practice
There is NO grace period because no authorised parking event happened
It seems to me that the time on site is more like picking someone up and loitering on a paid for, or free, car park
Lastly, we have not seen any signage pictures, or a redacted picture of the NTK PCN letter yet1 -

Not much point putting up pics of signage as (TBH) it is actually pretty decent on site.
Yep - not gonna lie, was picking someone up but thought I was out before 10 mins was up.
NTK PCN is a standard one but the time stamp on original is only to the minute - it was only apparent that I was over by 20 seconds once going through appeal as the time stamp of further evidence also showed seconds.0 -
Stopping waiting to load or unload is not parking
This will never see a courtroom2 -
Thanks for the info 😁Gr1pr said:They may not take it to a hearing in court, you are assuming a scenario that they don't tend to do
