Speeding Ticket advice ( Please)

Hi all ,
Recently received a speeding ticket with photographic evidence please see highly edited photos.

The issues I have are :

(i) difference in time on the letter received and the time on the photographic evidence quite clearly an exact hour difference one states 0411hrs and the other states 0511hrs

(ii) no evidence of doing the alleged 38mph
( no idea how it works )

(iii) the letter states ‘manned equipment’ ?

I do this same journey every Saturday morning and although I maybe guilty I never see many people/ vehicles  on these back country roads at this time.

I have 2 weeks left to respond , I was just curious if I could appeal the regarding equipment used as it is quite clearly inaccurate with the time frames being an hour apart - ( it was in fact 0511hrs at the time I was travelling),  or should I just accept it and move on.

Any advice would be greatly appreciated…

All 8 heavily edited photos (registration blanked ) from the  police portal + the letter.
Thank you kindly

I don't think you can use their typo as a defence.  And I know others have claimed the equipment is unreliable but without much success.

    1.  The photos clearly show the time as 04.11 GMT. We were using BST at the time, so the NIP shows 05.11. No discrepancy there.

    2. The evidence will be an officer's sworn statement, corroborated by the speedmeter reading.

    3. Why do you have an issue with "manned equipment"?

The device is set to GMT - it says so on the pictures. In September most of us have it clocks set to BST which they've correctly used in the letter. No, you can't use the fact that we use two different time standards in the UK as a defence.

The time on the photos is GMT which is one hour behind British summer time so the times are correct on both documents.

The only way to appeal is to go to court and plead not guilty’ a very high risk strategy, but what you must do now is reply to the NIP stating that you were the driver. Not doing so means 6 points for the more serious offence of failing to notify the driver.

The time isn't a typo.  Photo states 04:11 GMT.  In summer we use GMT+1.  Time of offence is 05:11 BST.
  • The camera image shows GMT, the letter is showing BST. Same time, the one hour difference is due to summer time. A lot of official records are done in GMT to avoid issues/errors when clocks change.

The equipment is stating GMT .. I suspect the argument would be the time on the NIP is BST  to give you a better chance of recollection …

You have no grounds for appeal.

You were doing 38.  It's a strict liability offence.

Thank you all for all your very informative swift comments, I had no idea of GMT / BST - lesson learnt !!!

    “Before Posting” Thread read…

“Manned Equipment” point being was only the fact  I saw nobody on or off the road , I guess cameras in the sky were manned, no issues.

Thanks again one and all …
