DCB LEGAL Smart Parking claim, post mediation stage

Another Leter of Claim received! (Previous thread was for another PCN on May 2025 with DCB which was dissolved). This is such a waste of time! 

This one is 90 free minutes over stay in Bridge Green, Prestbury 16th Feb 2024. I did not get any PCN or notices, until Debt collection letters cam through (ignored) then LOC 21st October 2025. Can I confirm that I am still sending the template, and not adding anything else content? I do not want to say too much. Thank you

I refer to your letter of claim.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:

You should revert to your client because the 'propensity to pay' score in my case is zero, so any claim is futile.

The alleged 'debt' is disputed and any court proceedings will be vigorously defended. I deny the debt.

Just put in an AOS to MCOL and wanted to check with you Para 3 is suffice to submit with other 9 paragraphs:

3. The Defendant was the registered keeper and usual driver of the vehicle at the material time. The Claimant alleges a parking event on 16 February 2024 at xxxxxx, for the reason stated as “Overstayed Free Time.” The Defendant does not recall parking at this location on the date in question. Crucially, the Defendant was never issued with a Parking Charge Notice, nor did they receive any Notice to Keeper, reminder, or correspondence from the Claimant that would have provided an opportunity to review the allegation or appeal. The first awareness of this matter arose only upon receipt of a debt recovery demand, long after the alleged event. In the absence of any properly served PCN or statutory notice, the Defendant denies liability for the charge.

I strongly suggest that you use the recent current Smart Parking DCB Legal bespoke template which is 11 paragraphs,  not 10, from the Smart Parking group thread by sluzz,  ( not the universal template defence. )

I just had my mediation appointment, the outcome is unsettled.

I used Smart Parking DCB Legal bespoke template and my defence over the phone is that the signage at the car park was inadequate and did not clearly bring the terms and conditions to the attention of drivers. I also never received the original PCN or any earlier correspondence. The alleged parking event was in February 2024, but the first I became aware of it was when correspondence arrived at my current address in September 2025.

The claimant states that the original PCNs were sent to my previous address, which I moved out of in November 2022. I updated my driving licence with the DVLA in December 2022, but I now understand that keeper details are obtained from the V5C rather than the driving licence. I honestly cannot remember whether I updated the V5C at the same time, although I believed I had.

The vehicle has since been sold back to the dealership, so I no longer have the V5C to check. The claimant has asserted that notices were sent to my old address, but I have not yet seen evidence showing what address was obtained from the DVLA.

How significant could this issue be? If the V5C address had not been updated, would that effectively defeat my argument that I never received the notices, or does the claimant still need to prove the address obtained from the DVLA and that the notices were properly served?

Any thoughts would be appreciated.

Ignore it and keep following those 8 steps in the defence template thread in announcements plus the 2nd post in the newbies sticky thread in announcements too, plus study the 855 discontinuations in the thread by Umkomaas

Eventually they will discontinue before the hearing fee is due to be paid

You should already know how these all end.

This'll be discontinued this Summer just before they have to pay the hearing fee. You've read Umkomaas' thread about it?
