Smart Parking

I have received a PCN which I have appealed because I was a customer and produced evidence by way of receipt.

They have sent the below however they say they have conducted a 'thorough' search but have not said what the search was and they haven't mentioned if there was a mis-key or not.

Because they say I have to go through IAS (not hearing good things about them) is this a lost cause and also... I have tried to pay the £20 but portal not working and the phone number they give is also no longer an option to pay.

Thank you for any advice on how I can best deal with this.

We can confirm that the evidence and circumstances outlined in your appeal have met the criteria outlined. Subsequently, you now have the option to pay the above PC at a reduced amount of £20.00 until 07/11/2025. If the reduced amount is not paid by the aforementioned date, the PC will increase to the full amount of £100.00. Furthermore, please note that whilst we have offered the reduced amount in this instance, this may not be offered again in the future. We would like to clarify that the PC has been issued due to Parked without the correct authorisation. As you have stated, supported by evidence, that the contravention occurred due to being a customer, The Private Parking Sector Single Code of Practice June 2024, stipulates that a reduced amount is offered. We note the comments made within your appeal stating that you had registered your vehicle onsite on the date in question however, we cannot rescind the Parking Charge on this basis. Please note, there is a system on site for motorist to provide their vehicle details, whilst their vehicle remains on site. This is the responsibility of the motorist, and for them to ensure that their full and correct vehicle registration mark (VRM) is registered on the tablet provided, so that their vehicle be made exempt from the advertised terms, conditions and parking restrictions. Having thoroughly reviewed our records, we can confirm that no validation was made against your VRM, consequently your vehicle was not authorised to remain on site as stated on the advertised Terms and Conditions. We can confirm that the contravention of unauthorised parking occurred as your vehicle remained on site for 52 minutes. We can confirm that this PC has been issued correctly, and we have made the decision to uphold the parking charge. The Terms and Conditions of the car park are clearly advertised around the site and must be adhered to by all drivers. You have now reached the end of our internal appeals procedure and therefore you now have two options, you can pay or appeal further with IAS – you cannot do both.

    Seems to be a common problem with Smart's advertised systems not working. You wouldn't know if their tablet for entering VRM was even working on that day/time.

    Even if you don’t pay the £20, drop Smart a short complaint just saying you found their pcn paying portal was not working on date/time and phone number provided gives no option to pay.

    PLAN A in NEWBIES Announcement thread - complain to landowner ask them to cancel as you were customer.
