Claim Form

I have taken no action on a parking notice and the debt collector’s letters or on the Letter of Claim.

I’ve now received a Claim Form from the court. Can I ask advice on how best to proceed please (can’t find a specific reference this in the Newbies thread).

It is from Euro Car Parks and the original notice from 2024 was for overstaying my paid for time, can’t remember by how much, but certainly less than 30 minutes over. They are claiming £286.56 from me, including court costs etc.

I went to court on a ticket once before and lost. I think that was Euro Car Parks as well. 

If I were to get a CCJ, do you know if this is treated the same way as other CCJs in respect of borrowing money etc?

    This wont get as far as a hearing,  nevermind a CCJ, pure speculation 

    Post the Issue date from the top right of the claim form below 

    Also post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first 

    Probably a typical ECP , DCB Legal money claim 

    Post 2 in the newbies sticky thread in announcements explains what to do, plus study the 8 steps in the defence template thread in announcements too

    Personally,  I would also read a dozen recent ECP DCB LEGAL claims,  see what they did with the template defence by coupon mad

    I have left my Claim Form at my mum’s by mistake and can’t easily get back there until after the 14 days from issue date has elapsed. Do you know if there’s any way I can find the claim number and password online please so that I can acknowledge it within the time limit?

    My mum’s blind and I don’t know where the form is anyway.
    It’s actually 19 days today, 14 days plus the 5 they allow from the date of letter until official issue date. I’ll be back at my mum’s in 2 days, worth sending the acknowledgment then do you think?

    You'll probably have to just go with that if there's no other option. 

    Your other claim may have been with Euro Parking Services via Gladstones. Euro Car Parks almost never go to hearings.

    When I went to acknowledge my claim just now 2 days late (see above), the form has this message.
     A Judgment has been entered against you. You cannot respond to the claim at this time but you may apply for the judgment to be set aside.”

    the judgment was made 2 hours before I logged on. Any advice on how to proceed now please?

    Looks like you missed the boat, meaning that you will have to pay the full total within the 30 days deadline to the lawyers involved,  otherwise you will get a default CCJ

    You previously said this won’t go as far as a hearing, does the fact that they have now entered a judgment against me mean it will now go to a hearing which I will automatically lose as I didn’t acknowledge in time, unless I pay the full amount?

    If you had followed the process correctly,  the claimant would have discontinued, before the pencilled in hearing,  meaning that you would have won with nothing to pay, and no hearing 

    They have pulled the trigger due to you not completing your AOS online by 4pm on day 19, so you missed the boat and lost, without the need for a hearing,  a default Judgment,  so again there will be no hearing

    If you dont pay the Judgment entered against you by the 30 day deadline,  it will transform into a default CCJ ( No hearing   )

    I am afraid that you missed the AOS deadline,  so lost without a hearing,  so pay it all to the lawyers,  in full,  ASAP

    It would probably cost you £313 to reset the process,  no guarantees that you would obtain a set aside,  and probably wouldn't get the £313 back either,  so pay it ASAP
