Claim form judgement

Hi all

I had received to a claim form. I replied to the claim form, following the steps in the newbies thread. I even have proof that I replied to the claim form, i did it online

Today I received a letter from the court saying I have not replied to the claim form and are saying I must pay £283. Then there is a note saying that if I dispute this judgement, I have to apply to the court office giving my reasons as to why the judgement should be set aside. And that this will incur a fee!!

Has anyone had experience of this before?

In the next few days I was planning to submit my defence and did not expect this!

It happened many times in the summer to emailed defences, ( and other emails  )  hence why we recommend direct entry on MCOL instead these days

Have a look at the complaints back in june and july

Email a complaint to claim progression,  with a copy plus time and date of their email auto response if you emailed a defence to the correct email address ( I hope that you didn't post it  ?  )

Mark the email complaint URGENT,  MISSING DOCUMENTS,  insist on a free set aside if it was the defence   ?

Or , by replied,  do you mean that you did the AOS online   ?  But not submitted the defence yet  ?

If its the latter, login to MCOL and copy and paste your claim history below Please

Post the Issue date from the top right of the claim form too, and the date that you completed the AOS stage online

What does your MCOL say? Does it show your AOS was submitted?
  • Hi all

So Gr1pr it was the AOS that I had submitted online but have nit sent the defence yet.

So I have logged into MCOL and can see that the AOS was submitted

This are the details in the history:

The claim form is dated 16/09/25

Your acknowledgment of service was submitted on 30/09/2025 at 10:17:32

Your acknowledgment of service was received on 30/09/2025 at 12:05:10

A judgment was issued against you on 22/10/2025 at 19:09:28

I do not understand why the judgement is issued against me as they haven't received the defence yet. I was in the time frames too?

Please can anyone advise me on what to do next?

    Regards

So claim form issue date was 16/09 2025 , AOS completed correctly,  so the deadline for the defence submission was 33 days after the issue date

They pulled the trigger the on Monday at 19.09 in the evening

I am afraid that you need to pay the lawyers   ( or claimant if no lawyers are involved   )  IN FULL , as soon as possible
  • You mean 19/10 was the deadline to submit the defence?
  • I thought I had 30 days after the date i submitted the AOS to submit the defence

No, 33 days from the issue date from the top right of the claim form,  not from the AOS date

The 28 days allowance is from the service date, which is 5 days after the issue date,  so 5 + 14 + 14 = 33

The AOS deadline was 19 days after
  • You misreading has been costly.
  • extremely costly
I am so annoyed at myself for this error
    Its extremely stressful

Thank you all for your help

With an issue date of 16/09/25 and if you had completed the AoS in a timely manner your defence deadline date would have been 4.00 p.m. on 20/10/25; not 19/10/25 due to it being a Sunday
