A new fibre broadband network has been supplied to the estate. Rather than burying the cable, it is supported on telegraph poles, spaced about 100m apart on the pavement. The road has a bend in it, and of course the cable goes directly from pole to pole. It therefore crosses the front gardens of the houses on the inside of the bend, at a height of around 10-15m.
Are the house owners entitled to a wayleave agreement? If so, how much can they expect to get?

Under the ECC, broadband companies have a right to run cables between poles, including where the cable passes over private land.
Cables can pass over land between two telegraph poles without the permission of the landowner as long as:
- The company does not need to enter the land.
- The cable is at least 3 metres above ground, or 2 metres above a building.
- The cable does not interfere with any business (defined as “trade, profession or employment”) for which the land is used.
