Notice from Lease Company re. PCN

Hello all,

We have received a letter from the company we lease a car from, stating that they have received a PCN in relation to the car we hire and giving us notice that they have 'made a representation' to the parking operator (Parkmaven) and that Parkmaven should now reissue the PCN to us.

The lease company have included with the letter a copy of the PCN.

Am I right in thinking I should do nothing at this time until Parkmaven send out a copy of the PCN to us directly?  From what I have read on here they have a set amount of time under POFA 2012 to send us the PCN as well as some other documents which should have been sent to them by the lease company - if they go beyond this time then they cannot invoke keep liability?

So I'm presuming I wait for the PCN, and if it doesn't have the other documents accompanying it, do nothing and just wait until that time period expires before I respond?

Please not do the appeal that was originally advised on the forum for lease cars.  That is now out of the window
  • Ok thanks I've found some of your other posts now on Parkmaven and lease cars...so I submit an appeal identifying myself as the driver, and then they will likely continue to pursue the lease company and that will be the grounds for my future appeal to Popla?

No you want them to pursue you only.
  • Ok thanks.  I will appeal identifying myself as the driver.
My appeal will be based on that I attended the site to charge my EV.  The EV bays were operated by PoGo charging, marked in bright red paint separate to the car park.  The EV pays had signage separate to the car park, in particular highlighting a 90 minute maximum stay for EV charging.
I returned to my car within that 90minute period and then moved my car on to the main car park.
In total I was on the car park in total for 2hrs 10minutes.  The car park has free parking for 2hrs.  The majority of my time there was spent on the EV charging space.  Well over  10 minutes was spent setting up the EV charge and then disconnecting and moving the vehicle afterwards.
I was also under the impression anyway, separate to the EV charging issue, that car parks are supposed to allow a 10minute grace period before a PCN is issued.
