ZZPS/QDR Solicitors

Hi,

I have just received an email from QDR Solicitors - instructed by ZZPS Limited, acting on behalf of Saba Park Services in connection with recovery of the 'debt' that they say we owe.
Brief overview of events:
- In Jan 25 We parked at a car park operated (it turns out) by Saba.
- I paid at the machine on departure but stupidly (muscle memory) put in my old car's reg plate instead of the actual car we were in.
- On 8th March we had a letter claiming we now owed £170 - we had received no letter to advise that we had infringed the parking rules before this, which we stated in an email to them. Two weeks later they acknowledged 'system errors' which meant original letters were not sent, but that the date had been rolled back and our appeal noted.
- To cut a long story short, we didn't hear anything back re the appeal outcome until a letter said we still owed £170. They claim they emailed and sent a letter to offer a reduction to £20 if paid within a certain time, following BPA regulations where a customer has made a major reg input error (I admit this fully). We never received any email or letter with this appeal outcome/offer and by the time we asked whaty was going on the time limit had 'expired' and no they weren't going to make any offer again. 
- We tried complaining via POPLA (try getting a new offer code from ZZPS was the only advice - ZZPS refused) and then BPA (can't help as they don't get involved in the difficulty of proving whether any notification was sent or received ie the crux of our argument).
- So, it is very difficult to prove you haven't received a non-recorded letter and also an email. We definitely didn't. They say 'check your junk mail' - no email.

At no point has anyone from Saba/ZZPS said 'OK let's just rewind to the fact you paid but made an error' and take it from there. It literally has been 'computer says no' from the off.

Our question is, do we pay up as requested by QDR just to get rid of this burden of to and fro and time taken out of our (working) days? Or do we push to make them take us to court? 

I am no lawyer but I would hope common sense from a judge would see that a customer who did actually pay for their time parked in Saba's car park (I have CC receipt for £15) albeit with a major error re reg plate does not then warrant being pursued for £170 more?! Our only evidence re ZZPS not having originally notified us of their appeal rejection and £20 offer is that we have it in writing from them about previous 'system errors' preventing letters being sent. How can they prove from their side they sent us anything if they have admitted they didn't send an initial letter in the first place? Would that stand up in court? 

Also, I made the stupid mistake with the reg no. at the time but because the car is in my wife's name, she is the named party in all correspondence and threats of court action. Not really keen for her to have to stand up in court going through all this nonsense, especially if there's a good chance they might win - I don't want any CCJs against either of us!
Thoughts/advice welcome.

    No paying,  ignore the powerless debt collectors letters and messages and calls etc

    You wont receive any CCJs if you follow our advice here

  • Thanks for the above advice - I resent having to spend any time thinking or dealing with outfits like this, or taking anyone else's time either. Also I really do not want to hand over any more money that what I paid to park in the first place. So, as above, I will ignore the emails from QDR - inetrestingly they are only sending emails, not physical letters, presumably because it's a dirt cheap way of intimidating people into handing over cash?! 

    I have had another email, text below, but I assume this is just one that will repeat over time?:

    We are instructed by ZZPS Limited on behalf of SABA PARK SERVICES UK LIMITED. We previously wrote to you in connection with the recovery of the Debt, which has been incurred following the failure to repay the above debt.

    Payment is now long overdue. If the Debt is not repaid in full within 14 days of the date of this letter, our Client may consider

    County Court Proceedings against you. If such a step is necessary, we will ask the Court to order that you pay our Client’s legal costs. These will likely be more than the balance of the Debt.

    If a County Court Judgment (“CCJ”) is obtained against you, its details will be entered on the Register of Judgments, Orders and Fines. It will remain on the Register for 6 years. Please note this may impact on your ability to obtain future credit as this information is available to lenders and finance companies. If a CCJ is obtained against you and you do not pay it, we may commence enforcement action to recover the above amount plus any costs incurred, via one of the following methods:

    - Issuing an Attachment of Earnings application. If this order is granted it instructs your employer to deduct money from your wages to pay back your debt.

    - Issuing a Warrant of Control application. If this order is granted the court permits the use of Bailiffs in the recovery of the total debt outstanding plus costs.

    Begging letter - well debt collector letter, which can be seen by the 14 day deadline - just ignore.

    ZZPS is a money scam approved by the BPA, ZZPS is known as the OSNER SCAM, the so called boss of ZZPS

    QDR has LIED to you because ZZPS cannot instruct them on a so called debt from another money scammer

    SO ... QDR, son of WHOPLA ?   What is WHOPLA ?   When the BPA owed money to London Councils WHO operated the appeals service, the stupid BPA appointed solicitors WRIGHT HASSALL as POPLA, hence WHOPLA was born.  What would happen is that WHOPLA would reject appeals and then WRIGHT HASSALL would sue the person

    A SCAM BEYOND BELIEF and the BPA GOT SHOT OF THEM.

    QDR are an offshoot of WRIGHT HASSALL
    and they really do spout utter rubbish. Show such a letter to a court judge what will he or she do, laugh QDR out of court

    BUT, as we have seen many times, the parking companies has no faith in QDR and the next contact could be DCBL. another so called legal who sits on the musical chairs legals. DCBL are known as court timewasters and chicken out bods.

    If this happens to you, let us know and if the son of WHOPLA, QDR takes you to court, be ready to show a judge that discussing letter which to say the least is indiminating  and very misleading

    Will WRIGHT HASSALL stop their son QDR for sending out such rubbish which should be reprted to the SRA

    Ignore QDR unless you get a claim form. Highly unlikely from this motley crew and yes, you'd be very likely to win if ever this was seen by a Judge.

  • Thanks for all the encouragement above - good to know that with that kind of history, these jokers were not going to get anywhere. As it happens, out of the blue, but in response to one of my many complaint emails I sent, I actually had a response from ZZPS:

    Good morning

    Reference: TFLxxxxxxx

    Thank you for your email.

    We have reviewed this internally, and there was a system error with the rejection being generated. Therefore we can either re-reject the appeal or we will hold this matter for 14 days to allow payment of the £20.00 to be made.

    So, seems I was right all along, big surprise!

    Probably not a popular move, but I did pay the £20, just to get the whole thing off my (our) back so that's the end of it.

    It has taught me quite a bit, not least to put the right bloody number plate in the machine! And if anyone is interested, this was at the North Greenwich station car park.

    So they lied to POPLA that a rejection letter offering £20 was sent. Then later admitted that was untrue. Yet you paid them £20?
