So is it good to use the SAR as evidence that I was never sent the tickets, because the SAR shows the tickets do not exist on their database?

And in my witness statement (I have not received it yet) do I say "in section xyz there are no pcns numbered .... that this court claim refers to, showing I was not issued nor sent these".

There will be those NTKs in the evidence pack. They do exist. The fact they were missed off the SAR doesn't matter IMHO.

Isn't the SAR a legal document too that has to include everything they have except their legal advice and GDPR of other people?

I'll double check the photos I have with the other tickets.

What evidence can I give that I never received the NTK? What is the evidence pack please? Thank you

A SAR is a request to a DPO for all of your data held on file by a company, including letters and pictures etc, but only your data, nobody else's

You cannot evidence non-receipt, you can state non-receipt, but its almost impossible to prove non-receipt

Your evidence pack is a bundle of Exhibits ( evidence. ) that accompanies your Witness Statement before the deadline

The Claimant must also do the same, Exhibits plus WS, same deadline

The lease states you must not park without a valid permit (nothing about displaying).

But their claim states you just parked in the wrong bay.

Defend what they claim. There is nothing in the lease about parking in someone else's bay.

They could and should have claimed you were parked without a valid permit, or that you blocked another vehicle's access to the space.

Hi thank you for your info. So if the SAR does not show the two PCNs they are taking me to court for, and the SAR has to include all data, and photos etc they have on me, then can I submit the SAR as evidence of no other tickets? I will state no NTK.

My witness statement will be ever so short - no NTK. My proof is how I acted when I received the first two (not their alleged first two) because I appealed them to the IPS (yes - whoops!!) Of course that isn't strictly evidence of not receiving either is it.

So I'm going to have to wait until the last minute to receive their evidence of photos. Are they likely to show these early? When you've finished laughing and wiped your eyes you can reply - no!

Thank you for the suggestion, good idea but they said "In an unmarked bay" so I think they mean "parking but not in a parking space" rather than in someone else's parking space.

That's not a good idea. You need more than that, including a link to the transcript by HHJ Moloney (first Beavis hearing).
