Issue with On Running trainers

Hi all

I've bought 2 new pairs of mens trainers this year.  1 in February direct with On and 1 in July with Tiso.

They are different models however both trainers are making squeaking noises.  Quoie loud and very noticeable.

I submitted a warranty claim to On for the pair in February and they knocked it back.  I wish to do the same for the July pair and reopen the Feb claim as I have now read this is a widespread issue and their is a legal claim now in the US.

Is there anything similar in the UK or any advice if they fob me off?  Clearly an issue and no other brands have the same squeak.

    The grounds for a claim under the Consumer Rights Act are that at the point of purchase the goods did not conform to contract.
    This means:
    The seller would have described the goods in the contract, so if the goods don't meet that description then they don't conform.
    In a consumer contract there are some terms which are implied even if they are not mentioned in the contract, such as that the goods should be of satisfactory quality and last a reasonable time.
    Finally, if you had discussed and agreed any specific requirements with the seller, such as they must be delivered before a certain date or they must be vegan, that that forms part of the contract and the goods must conform.

    There are lots of reports that the 'Oncloud' design trainers, where in effect you walk on a row of rubber Swiss rolls (OnCloud is a Swiss company), squeak.
    There don't seem to be any claims such as premature wear or any foot injuries caused by the squeak, but in the USA some owners claim they suffer severe embarrassment because of it. Some even claim that their work colleagues give them the nickname 'squeaky'.
    In some US states, this kind of social or workplace embarrassment can win you thousands of dollars in compensation for injured feelings and consequential psychological damage. 

    In the UK, I don't think a consumer rights claim for squeakiness as such would be successful. Does the squeak affect your feet or shorten the useful life of the shoes in any way? If so that would be firmer grounds for a claim.

    You ought to be running fast enough to be well away from any bystanders before they realise where the squeak is coming from...

    Why would a legal claim - if there is one - in the US have any relevance in the UK?

    Unless the warranty guarantees that they won't squeak, what made you think you could claim under the warranty?

    I suppose you might have a claim for not of "satisfactory quality" under the Consumer Rights Act, but I suspect the law might consider the squeaking to be a "trifle" or frivolity it doesn't concern itself with.

    Why on earth did you buy a second pair after problems with the first and your warranty claim was rejected?

    The class action in USA is almost certainly an irrelevance.

    It is not uncommon for trainers to squeak, or make other tuneful notes when in use as can be referenced from this thread:

    I am surprised that the marketing departments of these sportshoes don't play up to the fact, in a similar way to the Rice Krispies "Snap, Crackle and Pop" line.

    Even without the air bubble or similar features, many shoes will squeak just from the sole against the floor.
