PCN - EuroCarParks - Swallow Street Car Park Birmingham

Hello all. 

In short, the driver entered the car park, and took about 9 mins to download and pay for parking. They paid for 4hrs parking. They returned to the car, and left 2 mins after the expiry of parking. 

The total period in the car park was 4hrs11 mins. 

ECP have rejected our appeal (attached). <LINK REMOVED>

We have drafted a POPLA appeal based on previous successful appeals.

    Plan A in the newbies sticky thread in announcements,  complain about it ASAP to the retail park management company or landlord or landowner,  get it cancelled before using the popla appeal code,  but don't miss the popla appeal deadline 

    The BPA Code of Practice allows for a MINIMUM of 10 minutes grace period,  note the word minimum,  not absolute 

    Look at other recent popla appeal cases this year, where the victim is arguing about a couple of minutes,  like you

    Use their popla appeal wording based on,  congestion,  busy car park,  queuing vehicles to leave,  etc

    Also adding that the driver found it difficult to register the app for parking 

    But plan A first, then plan C ( popla   ) before the code expires

    You should win at POPLA as long as you don't get one of the more stupid male Assessors and as long as you go to town talking about how long the app took to download from scratch, after arriving, parking, walking over to the sign then reading it and complying with instructions.

    Tell POPLA that 11 minutes is in the region of the 'minimum 10 minutes' grace period and this is a large? busy? car park so taking a few minutes to use the app is entirely reasonable. No breach occurred.

    Don't copy irrelevant points about ANPR being unreliable or old stuff like that.
