BAYSENTRY , DCB LEGAL claim 2025
Hi All,
I have recently filed an Acknowledgement of service and I am looking to file a defence.
In truth I know I don’t have much of one. As I did accidentally overstay an hour in a shop car park (got the hours mixed up) - Granted this is a free carpark.
In truth If it was any other company I would have just paid up. However once I received the fine I saw it was DCBL. Due to this I haven’t paid, as I have only recently had a different parking case with DCBL discontinued (for a residential parking place) So I was begrudged to give them any money after previously wasting my time.
My question is, given I did actually overstay, is there any defence I can use? Or should I just offer to pay the original value of the fine (I will dispute any additional ‘admin’ fees)

Who is the parking company?
Maybe you did overstay, but it doesn't necessarily mean you are contractually obliged to pay anything.4 -
Firstly it's not a fine, secondly as you have already experienced, DCB Legal cases tend to be discontinued regardless of the defence filed. The main exceptions are when the parking company is Excel or Vehicle Control Services.
Always remember to abide by Space Corps Directive 39436175880932/B:

Usual templated DCB particulars, which suggests discontinuance is likely.
Use the templated defence and for paragraph 3 say something like you were legitimately using the facilities as a customer and were unaware of any alleged contract stipulating a ridiculous time limit.Hope you acknowledged service otherwise you've missed the deadline.2 -

to confirm, the process has now changed, you now need to submit the defense through the Mcol site?2 -
Correct, the 8 steps in the defence template thread in announcements explain the stages
Mcol is safer for you, no emails going missing, no default CCJ, as long as you don't overshoot the deadlines, in your case it's 4pm on 3rd November

You do not have to use the moneyclaim site but the previous method of submission via email has become unreliable. CNBC were either losing the defence or taking too long to update the claim which was causing unnecessary Default CCJs being issued.
