PCN in loading only bay with no restrictions

Hi there 

I was parked in loading only bay, no restrictions as per pics below. I was loading flowers to my car from my friend’s flower shop opposite the bay.
Saw a parking attendant taking note of my car and walked off. During this time I made few trips between car and the shop and saw him walking down the road not even looking my direction. On my last trip, he stood by my car typing up, I approached him and told him I was loading my car all this time, I was even holding a box. He issued a ticket and walked away.
I rang them first and woman on the phone (very rude) checked wardens GPS and confirmed he wasn’t standing next to the car but walked away, saying it was okay for him to walk down the road. In the letter they say ‘constant observation’, which wasn’t a case as I was making trips.
I appealed but got this reply, didn’t expect anything different from people that issued the ticket tbh.

This seems ridiculous and I was wondering if I can successfully appeal and how.
Any help would be much appreciated.

    Do you have business insurance related to the items that you were loading?
    Was your boot open for all that time, I always thought that is what counted as loading?
    You have been in the shop for 15 minutes, when they issue a ticket after 10 minutes?

    Hi there.

    #1 No, I don’t have an insurance as I was doing a favour to the business owner which is my friend.
    #2 No, I would open it for loading and shut right after, I loaded my back seats too the same way.
    #3 I told the warden that loading took me “15 minutes” (I didn’t really clocked how long it took, just said as this was roughly what I thought it took).

    In all fairness, I wasn’t rushing but I genuinely used loading bay for loading. Is 15min too long, how am I supposed to know rules when sign only said ‘loading only’? Hope you see my point.

    You should seek advice over on the Free Traffic Legal Advice forum they specialise in Penalty Notices issued by councils and police. This forum specialise in Parking Charge Notices from unregulated private parking companies.

    In general though, no, you can't just leave the vehicle for 15+ minutes and claim that you are still "loading" it.

    You can load and unload for 20 mins on double yellow lines 40 mins on single yellow lines and as the sign says in loading bays.
    But @Nellymoser has given you the best advice so far.

    I did not leave the car for 15 minutes. I was parked there for loading and it all took 15 minutes, I was in and out multiple times. Warden came, clocked my car and left, came back 10 minutes later and ticketed me. He was not there to see if I was loading or not otherwise I’d engage with him to make sure I’m not getting ticketed.

    Take it to the Traffic Penalty Tribunal (who are generally fair and not like the private parking equivalents).

    Quote this in your evidence and they will be expected to submit the GPS data, which will back you up.
