Initial Parking didn't submit evidence to POPLA on time (21 days was today) - and lo and behold, today I get an email from POPLA saying that the operator has withdrawn the appeal.
I guess that means the charge is cancelled? I've written to Initial Parking asking for in-writing confirmation of the same.
Yep, POPLA found in your favour after Initial failed to respond - charge cancelled. I wouldn’t hold your breath on Initial replying to your request for confirmation, you’re not dealing with John Lewis or M&S!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well, they responded to tell me that they didn't agree with my feedback quickly enough when I first complained! I live in hope

Initial Parking have confirmed themselves that the charge is cancelled.

    Hurrah!

Thank you all for all your help. The efforts of the diligent regulars in this forum are not unseen and I really appreciate the input, patient replying and exhaustive efforts.

This whole private parking industry is completely broken and needs to be legislated against. If Initial had contacted us in the first instance and said "you underpaid, please pay what you owe" we would absolutely have made good on the amount outstanding. The disproportionate fees and threats of CCJs are a completely ridiculous overreach for such small issues. I can't imagine having a government competent enough to do something about it, though.

It's already been legislated against, in 2019. The last Government acted and came up with a Code of Practice in 2022 but the parking industry blocked it with Judicial Reviews.

The current Government consulted on reintroducing a version of the statutory Code of  Practice; a consultation which ended in September but sadly included a tone deaf Options Assessment where someone in the MHCLG had been badly misled about letting the industry charge twice for the minor costs of a letter chain.

Hopeless, hopeless, hopeless at this stage. Sigh... Labour's effort is far, far worse than the Tories' Code (which was exactly as it should be but was scuppered by failure to consult properly). This is so frustrating.

I am on the Government Steering Group though. Have been since 2020. So they have heard from me about their errors.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
