  • In essence, very few people would risk buying a used car from a dealer if, despite doing their due diligence, a flag appeared on their vehicle post purchase. This is my experience here.

    So car bought from dealer. Was this a VW dealer?
    Bank transfer for deposit?
    Who is finance via?

    Sadly it is a wait it out situation. Nothing you can do to speed it up.

    So in essence your claim is against the dealer first, if you paid by finance and that was directly arranged (rather than taking out a loan) and the car was less than £30,000, there is S75a if the car was more than that, but it is complicated so whether it applies, which is against the finance company.

    Ultimately, it is not your car, it belongs to VW Finance. 

    Have you spoken to the dealer? VW Finance have no obligations to you, you are not their customer, the CRA would not apply in their dealings with you and they can recover the vehicle by means of a court order (which would not be in your name, but in the name of person who took out the unpaid finance). Think of it as equivalent to you holding stolen goods, they are not legally yours and can be recovered. 

    Essentially the dealer need to come to an agreement with VW Finance to allow title to properly pass to you, or the dealer need to refund you. Separate to that VW Finance can recover the vehicle.
