Filling out an IHT400, IHT409 Pensions & Deed of variation. Confused !!

Hi everyone. I am currently filling out probate and IHT forms for my late dads estate. 

A few queries have cropped up and wondering if anyone would offer help/advice


  1. On the IHT it asks questions around the persons pension. My dad was still working and died “in service” as a member of police staff. I believe that as he nominated myself and two siblings on record we will receive a death in service payout from the pensions fund. Is this something I need to declare on the IHT400 and “IHT409”. Should I get clarification from the pensions fund about whether the payout is “discretionary” or not? 
  2. Before my dad died, we lost another family member a month before. My dad was a named beneficiary on the will of this person and was due to receive half of her estate. I have since instructed a solicitor to help me with a “deed of variation” for the will so that his share is going to be diverted to myself and my siblings rather than hitting his estate. One of the questions on the IHT asks “is this person due any inheritance” I’m not sure if I have to declare this or not?

    It should be declared on IHT409, but as you will be answering yes to question 12 the amount does not go across to IHT400.

    You should not have to declare it with a DoV in place.

    Thanks! I assumed not either but before I go ahead and send the forms off I wanted to check. I’m awaiting this answer from the solicitor doing the DOV but nothing back off her yet
