Smart parking PCN


You are notified under paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this notice in full. As we do not know the driver's name or current postal address, you the vehicle's keeper are now invited to either:
1. Pay the charge, or
2. If you were not the driver at the time of the event, please provide us with the driver's full name and current postal address using the contact details below and pass this Parking Charge to them. (Once this information is received, we will pursue the driver)
This Notice is given to you under Paragraph 9(2)(f) of Schedule 4 of the Protection of Freedoms Act 2012 and is subject to our compliance with the applicable conditions under this Act. If within 28 days, beginning with the day after that on which the notice is given (which is presumed to be the second working day after the date of issue) the amount due has not been paid in full and we do not know both the name and current address of the driver, we have the right to recover any unpaid part of the notice from you, the keeper.
Their issue date is marked 10/09/2025 -- however that's an obvious lie as I only got the letter on 16/09, and that (if I can still count) is 1 day over the PoFA limit since the event is from 01/09.
I appealed on their website with the standard appeal, and added that their notice wasn't PoFA compliant because it was over the allowed time limit. Their reply just leaned on their untrue 10/09 issue date, saying it was within the 14-day limit.
Any ideas on what should I say to POPLA? Is is just their word against mine on the date thing?

Smart Parking hopped to the IPC this year, so there is no POPLA for you.You could try an appeal to the IAS for the LOLs but with your eyes wide open: it is a shocking kangaroo court, by all accounts we see.
Only 4% of people see an adjudication in their favour and the assessors are clearly not impartial so most people swerve the IAS stage altogether and sit tight.
Perfectly safe and valid decision if you choose to ignore it completely. Ignore debt demands. Tell them if you move house, as you need to check each letter and come back if you get a claim form.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
