Second home Council Tax: Wales

My wife, brother and I put together money to buy a house in Wales. The names on the mortgage were only my wife and I which my brother approved of. We intended for the three of us to live in the house together. However, it didn't work out and my wife and I bought another property to live in leaving my brother to live on his own in the original property. My brother is on benefit so he doesn't pay Council Tax. I was wondering whether we would be responsible for the second home Council Tax?

Unless Welsh CT rules are different to English, as your brother is the sole occupier then he is responsible for the CT
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • Why have you not added your brother's details to the deeds? I don't know the answer but could this have any implications on the benefits he receives?

Tenants normally pay the council tax, and the landlord becomes liable when it's empty. Although you might not be a formal landlord, the situation is basically the same.

Doesn`t that make him a tenant? Don`t you need a lease and maybe a BTL mortgage for him to be a tenant? He should have his name attached to the mortgage.
