Outstanding PCN | Being chased by QDR Solicitors

[Deleted User]
[Deleted User] Posts: 0 Newbie

Hi all, hoping someone here can give me some advice or share if they’ve been in a similar situation.

I got a text from QDR Solicitors about a £170 charge for an unpaid parking fine. I called them, and they said it relates to an old NCP parking charge.

Here’s where it gets confusing: I actually rang NCP last month to check if I had any outstanding payments or PCNs on my account. They confirmed at the time that I had nothing owed.

Now, after getting this message from QDR, I called NCP again, and they’re suddenly saying there was a PCN — but that it’s now out of their hands. They said all correspondence went to my old address, which explains why I never received any letters or notices before this stage.

I’m trying to get written confirmation from NCP about that first call (where they told me I had no outstanding fines) so I can send it to QDR as “proof” and hopefully show that this shouldn’t have escalated.

A few questions I’m hoping people can help with: • Would this kind of situation still get escalated to court / CCJ stage if I’m now engaging with them? • Is it worth sending QDR that evidence and explaining I was misinformed by NCP? • Has anyone managed to resolve something similar without paying the full amount?

Any advice or next steps would be really appreciated. I just don’t want this to spiral into something worse when I genuinely had no idea about the PCN until now.

Thanks in advance!

Yes they might issue a Money Claim   ( not a CCJ  ) , but it might not get to court

NCP might use a legal company to sue you

QDR and any other 3rd party contractors can only act on their clients wishes,

Court is where any case should be in order to mull over Exhibits, Evidence and Paperwork

If you never received a pcn,  tell NCP to reissue it under the current code of practice

No that's pointless. Just ignore QDR & NCP apart from emailing a data rectification, stating that the old address must be 'erased'.

Has anyone managed to resolve something similar without paying the full amount?

Literally everyone!  You'll never pay this.

Do also tell QDR & NCP in your email about the old address erasure, to pause debt recovery and reissue the PCN, in view of the fact it was never served (a clause about that is somewhere in the current code of practice).

    They won't.

    But that's not the point!

Do all that, then relax. Stop engaging:

IGNORE IT UNTIL YOU GET A CLAIM FORM, BUT YOU'LL HOPEFULLY KNOW ALL THIS FROM POST 4 AND POST 2 OF THE NEWBIES FAQS THREAD.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
