Moorside Legal - CCJ - N244 Help

Hello,

I've been reading back through various threads which are similar cases to mine. There's some really helpful info on here! I thought I'd post my issue to see if anyone can help me a little further.

A CCJ was made against me by UK Parking Control on 27/05/25. Moorside Legal are acting on their behalf.

I first became aware of this four months after the CCJ on 01/10/25 when I checked my credit report and saw it on there. I had no correspondence regarding this CCJ, and no idea it had happened until this point. The reason I had no idea about this, is that it was issued to an address I vacated in January 2021.

The alleged parking offence took place in November 2021, and I subsequently received correspondence from DCBL in November 2022 addressed to my new/current address. SO DCBL KNEW MY CURRENT ADDRESS YEARS AGO. SURELY MOORSIDE LEGAL SHOULD HAVE ALSO CORRESPONDED TO THIS ADDRESS?

I feel I have a strong case for this CCJ to be set aside, as DCBL knew my correct and current address from 2022. Yet in 2025, Moorside Legal were using my old and incorrect one.

Since discovering the CCJ, I called CNBC to get as much information as I could about the matter. I then emailed Moorside Legal stating I was never served the Claim Form or any related court documents, and I intend to apply to the court to have this CCJ set aside. I've asked them to give me:

a) a copy of the claim form and particulars of the claim
b) a copy of the judgment
c) copies of all evidence to support the claim (NOTE - I ASKED DCBL BACK IN 2022 FOR PHOTOGRAPHIC EVIDENCE OF MY PARKING BREACH, AND SENT THEM A CREDIT CARD STATEMENT PROVING I HAD PAID TO PARK THERE. DCBL AND UKPC HAVE NEVER RESPONDED TO THAT OR SHOWN ME PROOF I BROKE A PARKING RULE)
d) all documentation sent to the incorrect address

It's been two weeks now and they haven't replied to these requests. I also sent a similar email to caseprogression.cnbc@justice.gov.uk two weeks ago. No reply from them either.

My questions are:

a) What should I do now?
b) What chance do I have of getting the CCJ set aside?
c) What chance do I have of getting Moorside to pay my costs if I am successful in doing that. It's going to cost me over £300 I think pursuing this.

I am looking at this N244 form, and don't have the information I need to fill it out. And there are all sorts of questions on there I don't know how to answer...

If you've read this far, thank you! Any help or advice very gratefully received!

    a) wait till next week then do the N244 with a WS & evidence of the Claimant's other agent knowing the correct address all along, and proof from your free Credit Report that your address was up to date & showing;

    b) 100% it'll be set aside.

    c) 99% as long as you take your judge to the binding case law in VCS v Carr. Insist that the costs must be paid by the C and that their claim is EXPIRED (4 months has passed) so the claim cannot be resurrected and is dismissed (per Carr). This might well be news to your judge - they can't be expected to know about every piece of case law but WILL look if you explain & link the case - so preparation by you is key.
