Monoblock Service

Hi, I’m looking for some advice regarding mono blocking a small grass strip across attached to my driveway. I have spoken to the council and they have advised me, they don’t own that piece of land, instead i was advised to contact factor who then replied, i can’t despite there are no access to mains, hatches or manholes in this area. Then they pointed me out to this. 

I can confirm that although there are no access hatches or manholes in this area, there are underground utilities and services such as Electrical cables, telecommunication cables, water mains, gas mains, & Drainage/sewer pipes running below the turf for ease of access for maintenance purposes.

 

Therefore, as it states in the deed of conditions (See extract 23.12 attached) and the title plan previously provided, no alterations can be made on this ground.


23.13 The Owners shall leave all Service Strips open and unbuilt upon in all time coming and the Owners shall not be permitted to erect any buildings, walls or fences over or to plant trees, shrubs, plants of any kind or hedges within or upon the Service Strips nor to alter the surface level over the same or to do any other thing over or adjacent to the Service Strips which would be likely to damage Services contained within the Service Strips or to make access thereto more difficult.

Could you please help with some advice around this?

    What advice are you looking for it appears very clearly that you are not allowed to make any alterations to these service strips?

    Thanks for your reply, basically my neighbour does not have any objection with me completing the work as it doesn’t interfiere in their boundaries/ territory. I’m just curious if the explanation given to me has any truth in it… as well as i could potentially use stones instead that could as well be used i read of grass and will still be the same to remove as grass in case the service strip needs to be remove for any service which has not been the case for the last 6 years as any service carried out, the access come from the main street path if you like… or should i just be a !!!!!! and drive over the grass… That would annoy quite a few including the factors 🤣. I just don’t see why is the service strips are own by all off us and nobody have any objections they would deny the work when in fact, the work intended to be carried out would benefit the kids, community with an extra path for kids to walk on and less maintenance work… Could the factors take me to court?

     If there are cables or pipework for utilities under the area, then I'd suggest that it's possible that the weight of a vehicle might damage them. There is a reason why they say keep such service strips easily accessible and say don't plant things, cover them etc

    The depths utility services are installed vary with the surface above them, surfaces for vehicular traffic have greater depth, which a service strip might not have thus making damage more likely.
    The damage that HGV's can do when parking with one wheel off the road can be quite expensive to fix.
