Court claimant witness statements

I'm the Defendant in a small claims case concerning an airport no stopping zone 'PCN'. The case is due to be heard on Wednesday, but the claimant has submitted a supplementary witness statement against my defence, asking for the case to be struck out. What do I do next? They are also saying they may not attend!

    I think that is fairly standard.  They try to frighten you into paying for something and then closing the case down at the last minute.  

    To those that know - should the OP call the court to confirm the hearing?  it would be dreadful to get a CCJ when the PCNers are saying they don't want to proceed.

    But that's all normal. They'll send a rep.

  • Everything filed as the paperwork required. They just seem to be trying to get it bumped. I was under the misapprehension that once we'd filed our statements, that was it for the court until the day.

    Feel free to bring up the supplementary statement up and say it adds nothing new, is a common tactic by VCS/Excel and should be disregarded.

    As is the "I might not be able to attend" when in fact the witness NEVER intends. The witness has signed a statement of truth and to claim he "might" attend every time when he has no intention of doing so is contemptuous.

    Did they ask for the case to be struck out or your defence?  Surely if the case is struck out, that is the claimant shooting themselves in the foot and good for you?
