Travel insurance claim

I booked a holiday in Montenegro for my family of 4 and my brother, with all of us sharing a Villa. A week before the holiday I punctured my lung and couldn’t fly, so I cancelled the holiday. (My family could have gone without me but didn’t want to.)

I have travel insurance for 3 - me, my wife and my son. My daughter is 19 so can’t be on our family travel insurance, so she has an separate policy. My brother also has his own policy. 

After a ludicrous amount of delay the travel insurer is paying the claim. However because the Villa was booked for 5 people, and only my family of 3 are on my insurance policy, they will only pay 3/5 of the costs of the Villa. 

I am not sure this is fair or reasonable - thoughts? Of course my daughter and brother could have gone without the rest of us (although it would have been weird), but then they would have had to pay the full cost of the Villa between 2. And although they each have their own travel insurance I’m assuming they won’t be able to claim on their own policy, since they didn’t suffer any injury. Or can they claim back for their share of the Villa on their own travel insurance using my injury as the reason?

    Thats how travel insurance works, it covers the travellers for their share of the costs. 

    Your Daughter and Brother should claim off of their own insurance for not travelling because of your illness. As long as it wasnt related to a pre-existing condition their claims should be fine as well unless they bought particularly poor quality insurance but even that should be ok given the close family relationship. It's up to the 5 of you to agree as to what happens to the amounts claimed.

    Daughter and brother need to read their policy document to see if they are covered for cancellation due to illness of a travelling companion
