Can anyone offer advice Lowell Financial???

  • Thanks everyone so much for this post. I was just about to call Lowell and I saw found this forum in the nick of time!!

    My mother had a call this morning from Lowell looking for me and although I haven't lived at home for 15 years, I do have a very old debt from then - I wonder could this be the past catching up with me. Yikes.

    Am now very worried about how much interest a 15 year old debt might add up to.

    interest = NOTHING, it's been 15 years and you haven't heard from them so the debt is statute bared. Or have you heard from them withint he last 6 years?
  • No I have heard absolutely nothing, this is completely out of the blue.

    Seems strange Bluerover has also recently received communication and I wonder how many others. Perhaps Lowell have bought some of this old debt that is being passed around at the moment?

    Maybe I'll be recieving something. I have been paying them for awhile now cetelem sold my account to them so they went on my DMP. I have only recently (just before christmas) given them my new address. Maybe coz I'm paying them I won't.

    Can I ask for my CCA even when I know who I originally have the debt with & that I've been paying them?

    It sounds like this is statute barred. You need to send the SB letter, which I will post shortly.

    Not strange at all about Lowell. They and a number of companies buy very old debt and then try to extract money from people who do not know the rules. They only need a few percent hit rate to make a good profit.

    Debrag - you are legally entitled to request a valid copy of your CCA at any time. Ethically, if you took out a debt, you should repay it - but yes, you can ask for it. Overdrafts do not require a CCA though so you may need to watch for that.

    I don't have an overdraft with them or do you just mean in general

    Since your debt is likely to be statute barred, you need to send the letter you find on here

    preface the letter with

    I do not acknowledge any debt to your company

    and send the letter recorded delivery. If they come back with evidence that the debt has been acknowledged in the last 6 years, then you can send the CCA letter later. Even if you have not paid it, if it is a joint liability, there is always the risk that the other party has acknowledged it.

    As you may see from the link provided, Weller not only stopped paying the company, but got monies already paid to them refunded. Not sure if this involved going to court or just the threat of going to court, but possibly worth researching some of weller's threads to find out what happened.
