Totally stuck house sale

The buyers solicitors are now saying they cannot report to the buyers or send contracts as there is one (supposedly) minor question outstanding from the lender and they won't report until that is responded to and they don't know when that will be. They are still refusing to even discuss potential exchange and completion dates.
We have requested an exchange this week, if that does not happen (and we don't expect it to) we will inform them we will re-list the property in 10 days time. It's so frustrating it's come to this, we've spent a fortune in solicitors and survey fees, but the even the estate agents now think they are deliberately stalling.1 -
Yep - apologies, I misread what was said about the holiday, and wasn't suggesting for a moment that the OP should call the OP's solicitors.sheramber said:
It is not the OP’s solicitor that has gone on holiday. It is his buyer’s solicitor.EssexHebridean said:
See my post above yours. This needs escalation, and you now have a further ground to add to that as well with the holiday thing. Taking holiday is absolutely fine - failing to put anything in place to cover current transactions is not.mat1964 said:so the latest is the buyers solicitor has gone on holiday for 2 weeks, without informing anyone (my solicitors found out via her out of office message). In the meantime, our solicitor has said "the buyer’s conveyancer keeps feeding us incorrect information". So now the estate agents are trying to see if this has to wait until the solicitor returns as it's not a small firm, but it appears so and the solicitors are blaming each other for the delays.
Don't bother with the agents now - they can't escalate this (and probably won't get past the switchboard), you can.
I don’t think the OP will get past the switchboard there. He is not their client.
OP - if issuing ultimatums then you have to be solid about following through, otherwise, far from strengthening your position, you will actually weaken it.🎉 MORTGAGE FREE (First time!) 30/09/2016 🎉 And now we go again…New mortgage taken 01/09/23 🏡

I wouldn’t issue an ultimatum. I’d just remarket, and let the buyer know that I’m still happy to proceed with them.
No reliance should be placed on the above! Absolutely none, do you hear?0 -
Are you not in a chain then?mat1964 said:We are selling our house and buying another. No chain either side. We are ready to exchange on our purchase but the sale is totally stuck. The buyers solicitors have said they have not had satisfactory responses to questions but refuse to clarify which responses they are not happy with. Our solicitors say they have answered all their questions and emails to clarify what else they want go unanswered. The estate agent has spoken to the buyer who just refers him back to his solicitor and won’t get involved. We will lose our new house if this goes on too much longer but every time we chase both our solicitor and the estate agents we get the same response “we can’t do anything until the buyer’s solicitor comes back to us. Pretty much out of ideas now!
If not then assess if it's too much hassle and set yourself a break point.
If you are then this onwards purchase sets your critical timeline and break point.0 -
OP, get your agents to relist it TODAY. You'll keep all options open, a new buyer, the current buyer if they can be a*sed and maybe getting your money back on your current incompetent solicitor if you get a new buyer. Starting a fresh0

Or alternatively, the current buyer may simply decide to walk leaving the OP liable for paying part legal fees on the transaction without actually achieving a sale. There is always a risk in remarketing and it shouldn't be assumed that it is ever a "win/win" option.🎉 MORTGAGE FREE (First time!) 30/09/2016 🎉 And now we go again…New mortgage taken 01/09/23 🏡

So no new news. We are going to leave it until the main solicitor returns from her 2 weeks holiday on Monday and see what she has to say, if anything,
We live on an estate where sales are very hard (don't know why, it's a lovely place) - so re-listing would almost certainly mean we will lose our purchase. There is no chain other than our buyers and sellers.
The estate agent has tried to contact the buyers this week but they are not responding so we really have no idea if they want to proceed (we think not but why they won't say I don't know). I think if there is no exchange next week the property we are trying to buy is going to re-list anyway.

I would determine that is a chain, you are selling, you are relying on the sale to enable your next purchase = chain:How does a property chain work?
A property chain is when a group of property buyers and sellers are linked together because their purchase or sale depends on others. If you’re in a chain, this can mean that moving house could take longer or be more complicated.
The longer the chain, the more likely it is that something can go wrong. When this happens, the purchase or sale of a property may fall through.0 -
The OP didn’t say that there wasn’t a chain, just that there was no chain either side.🎉 MORTGAGE FREE (First time!) 30/09/2016 🎉 And now we go again…New mortgage taken 01/09/23 🏡

But they appear to be in the middle which is the critical consideration.
Their onward purchase cannot progress as their buyer's agents appear to be stagnant.
Unsure what difference you are trying to establish.0
