Contacts estate agent

 Hi is it binding   my father  died  i was an EXCUTER to his will,  as well as my partner. 
I signed  a contract to sell the house with the agent but not the other EXCUTER  who refused to as it was a bad agent , is it legally  binding  without  the other EXCUTER

    Are both EXECUTORS named on the grant of probate ? (assuming you already have probate - you won't be able to complete any sale of the house without it)

    The word is "executor", it does not have to be written in capitals.

    So there are two executors, you and your partner?

    Sales of property requiring land registration (like a house) require all executors to agree to the sale.

    As only you have signed maybe (depending on contract wording) just you may be liable for agent suing you.  

    When you have agreed an approach with other executor suggest speaking to you then joint solicitor about what YOUR contract with agent binds you too. 

    Wording of contract matters.
