Hello, I received a PCN for parking back in July for ‘failing to pay’. I did in fact pay for my parking but I put the wrong registration number on the app so my car flagged up for non payment. The day this happened I was in A&E for 16 hours the night before and I hadn’t slept for 36 hours as my 1 year old was being treated for sepsis. I had every intention of paying but due to the sheer exhaustion of the previous day, I parked on my return from hospital at 10 in the morning and made a mistake on the app.
I appealed this with NCP and they reduced the fine from £60 to £20 however I still did not want to pay this due to the circumstances, I had every intention of paying for my parking & I did but under the wrong registration.
I then escalated this to POPLA and advised them of the above and their response was that ‘although they sympathize with me, they cannot accept the appeal on this basis’. Even though in the POPLA website it explains that under extreme circumstances e.g a medical emergency the prevented me from keeping to the parking conditions they would accept the appeal. I understand it wasn’t as though I overran my time at parking at a hospital and was fined and it was on my return from the hospital but surely this counts as a medical emergency and my brain wasn’t operating as it should be due to the stress and lack of sleep??! I now am being told that instead of the £60 or the £20 fine, it will be the initial rate I will need to pay of £100 if I was to have missed the 14 day deadline in the first instance.
Where do I stand with this? I can’t escalate further with POPLA as their decision is final, do I pay the fine or let them take me to court? I don’t want to risk getting a ccj as my credit history is clean and don’t want it to affect me in the future.

If this was a hospital car park you should complain to the hospital and insist they get it cancelled.
If NCP took you to court the only way you could get a CCJ is by not defending their claim or losing and not paying within 30 days.1 -
