Car Park Management UK / BW Legal. Defence (car parked before rules were enforced)

Hello all.

In May 2024 I parked my car on a road within a private industrial park with no parking restrictions in place, leaving possession with a garage to do work on the car.

I collected the car in June 2024.
A couple of weeks later I had a PCN from Car Park Management UK for parking here.
In the month between me leaving and collecting my car, the land owner had put up parking restrictions and thus my car was now perceived to be breach of these. There was no contract to be made since the signs were not there when I left the car.

The garage told me "not to worry", they will sort it.
I have perhaps against better judgement let this go on and on with BW Legal sending me numerous threatening letters. Now the court form has arrived. The garage tell me the other cars that got fined on the same day had this sorted out due to it being clear 'entrapment'.
Mine clearly hasn't so I need to now form a defence.
Is it worth at this point contacting the Landowner and explaining the situation as I am sure he will recall what happened and have the history of what happened with the other cases.
Or do I now just write the above points in my defence?
The invoice date from the garage even matches the PCN date.

Thankyou.

But all my post has been arriving late so now I'm in a rush to reply within the 14 days (as I understand it, it's 14 days 5 days after issue, so deadline 13th October).

Yes but that's just a case of doing the AOS which you can do tonight to buy more time to defend. See the AOS dropbox walk-through, in the NEWBIES FAQS thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

When the time comes you could ask the garage owner to write a short witness statement to accompany your own, if he'd be willing.

    Thanks, AOS completed online.
In these coming days, should I make contact with the Landowner or has that opportunity gone?

Probably too late but not a bad idea to try, if only to hammer home your anger that they've let loose this litigious monster at you.
