Armtrac PCN Appeal Final Letter

Hello, I have looked through the Forums trying to find an answer before I post this, but there are too many and the helpful hints don't seem to cover our issue.

We had a PCN for parking on Private Land. We bought a ticket and it has the right registration on it and the correct charge paid, but it was a windy day and the ticket was on the dashboard in the windscreen with a pair of sunglasses holding the ticket down. The details of the ticket could be seen, as the glasses were laid on their rims to show the ticket details.

We appealed to Armtrac 4th August and we've been waiting for a response. Today we received a letter for Debt Recovery before being passed over to BW Legal Solicitors.

  • We did Appeal. We have confirmation of the Appeal Received and yet we have not received any notification at all of its result except the letter of Final Recovery. Where are the 'Stickies' and I'll read them. Thank you for your help.

    The appeal will have been turned down (they always are) and you'd be ignoring them anyway.

    Sit tight. Do nothing except tell them if you move house, of course, but that's common sense not parking related.

    Ignore the £170 debt demands, obviously.

    Still unsure that we are right? Just click on the little red 'MSE link' in the small 'Parking Ticket Appeals' banner at the top of this page which leads to the MSE Guide to fight PCNs.

    Same info is shown in both this forum and in that Guide, as regards the debt recovery letters being a futile stage and risk-free. Consistent advice here is easy to find and not just from random strangers. The MSE Guide is official 'Martin Lewis backed' advice.

  • Ok, thank you all for your help. I have had a 'Live chat' today with BW Legal and their Agent Danny. It transpires that we held the ticket down on our dashboard with a pair of sunglasses, but ensuring the arrival time and amount paid are visible and this has led to the Notice being issued. The T&Cs of the car park (an image provided during the chat) shows 2 things. 1 the ticket must be displayed for the time information to be displayed. 2 there are only 3 payments for parking for during the day. £4.50 for 3 hours. £6.00 for 12 hours and £10 for 24 hours. 

    Something has gone funny with the Live Chat as there's more to the below conversation and now, I've been blocked from chatting with them.

    I've just been chatting to you and thankyou for the images included in the Chat. It can be seen in your image that Mr Nicholson arrived 01/08/25 at 14:18 and he paid £6.00. May I ask why the ticket was issued when the T&Cs say 'the time printed information to be inspected' May I ask why the expiration time is important, when clearly Mr (redacted) paid for 12 hours after arriving at 14:18

    As advised in the previous chat, should you dispute this matter then we would recommend that you seek your own independent legal advice. Our client have already rejected you appeal and we will no respond to the same points raised.

  • I complained to Armtrac and the IPC and the response from the IPC? We didn't correctly appeal to Armtrac, they said

    "To follow the correct process, you must do so in writing to the following process.

    Please submit a complaint to them via post to;
    Complaints Department
    Armtrac Security Services, PO Box 154, Penzance TR20 9WD"

    Even though on the issued PCN it says "All correspondance should be made to the address above or Armtracservices.zatappeal.com" so we appealed to Armtracservices.zatappeal.com and have confirmation of the appeal received and now I'm wondering what to do? Should I appeal in writing still?

    Your appeal would have been declined so why are you bothering
    just deal with any court claim

    You seem to be muddling up your appeal with your complaint.

    The IPC are saying you had to mail a complaint (this is nothing to do with an appeal).
