Aftermarket car warranties are designed not to pay out on anything that is likely to go wrong.  Car dealers love them because you end up fighting the warranty company, and forgetting that you have consumer rights against the dealer that sold you the car.
If the car goes wrong within 6 months of purchase, then it's assumed to have been faulty at the time of sale, unless the dealer can show otherwise.  It's then their responsibility to put it right.
So do I have to take them to court?
Not necessarily, but at this stage that's premature, anyway.  Until you have a diagnosis there's nothing else to do.  The dealer has asked you to take it to an RAC-approved garage.  I appreciate they're suggesting that because as Ectophile says, they're trying to keep you on a warranty track, but until you know what the problem is you're stuck.

I'd go back to the dealer and say that you want to deal with this under your consumer rights, not warranty, so they (the dealer) should either inspect the car themselves or pay for you to have it inspected at an alternative place (which may be RAC-approved if they want it to be). Once you and they know what the problem is, you'll know whether this is a reason to reject the car and/or insist the dealer fix it.

Thank you for the advice Aylesbury - I will see what it costs for the diagnosis and if its a reasonable cost then take the results to them albeit electronically as they are 200 miles away from me.

I put down a 2k cash deposit and the rest was on finance with no bubble just paying it monthly.
