How much are you hoping to claim?miny1500now said:Hi im looking at taking a company to court regard the workman ship done at my property, is there a No Win No Fee Solicitor that takes this on ?
If its under £10k then its likely to go into Small Track in which case solicitors fees cannot be recovered from the other party and so most won't take on such a case.
Do you have Legal Expenses on your Home Insurance? If you do they may provide representation if they thing you have a 51% or more chance of succeeding.0 -
do you have legal cover with your house insurance as that would cover this too, but they will do 3 tests, first is there a case, 2nd is there a 51% chance of winning and will they be able to recover the value of the claim, they will only do the case if all 3 tests are successful.0

There is normally also a test on if the cost of bringing the action will be appropriate for the value of the claim... they won't cover £400,000 of costs to support you trying to claim £50 back.is1971de said:do you have legal cover with your house insurance as that would cover this too, but they will do 3 tests, first is there a case, 2nd is there a 51% chance of winning and will they be able to recover the value of the claim, they will only do the case if all 3 tests are successful.
Never seen a condition that the defendant has the means to pay the claim, though arguably that could be wrapped up in the success assessment.0 -
I tried to take my roofer to court also because of a bodged job and it was declined because the chances of getting the cost/claim from the roofer was unlikely to be successful so it was declined.0

Who declined it?is1971de said:I tried to take my roofer to court also because of a bodged job and it was declined because the chances of getting the cost/claim from the roofer was unlikely to be successful so it was declined.1 -
Do you think they have the funds to payout if you win?miny1500now said:Hi im looking at taking a company to court regard the workman ship done at my property, is there a No Win No Fee Solicitor that takes this on ?Life in the slow lane0 -

You could have still taken it forward yourself.is1971de said:

So they didn't consider it worth spending money pursuing it. The chances of finding a solicitor taking it on would seem to be slim because in a NWNF arrangement they won't get paid in the (seemingly likely) event that the claim is unsuccessful or is successful but the roofer won't or can't pay.is1971de said:

You can pursue it yourself, but you'll have to take the same view as to whether it's worth spending time and money to do so. How much would you be suing the roofer for?0
