TERMS AND CONDITIONS FOR THE DRAW

These terms and conditions establish the rules governing the award of the prize in the Catalonia, Get excited draw

1.     PROMOTER OF THE DRAW

The Catalan Tourist Board (hereinafter “the promoter”), Spanish Tax ID No. (NIF) S0800470G and registered office at Carrer d’Aragó 244, Barcelona, is the promoter of this random combination promotional draw for the international tourist destination of Catalonia (hereinafter, “the promotion” or “draw”).

The Catalan Tourist Board reserves the right to cancel, suspend or amend these terms and conditions and the organisation and/or management of this promotion whenever there are any grounds to justify it.

2.     TERRITORIAL LIMIT

This draw has a worldwide territorial limit since it is held online and therefore anyone of any nationality or place of residence can enter it.

 

3.     ELIGIBILITY

All individuals over the age of 18 of any nationality or place of residence who have not been involved in designing or arranging this draw in any way are eligible to enter it. This condition includes employees of the Catalan Tourist Board and any partner companies as well as their spouses, parents, children and other relatives by blood or marriage up to the first degree. Failure to comply with this condition will result in automatic forfeiture of any prize won.

Entry is free and constitutes full and unconditional acceptance of these terms and conditions which will be made available to entrants so that they can view and download them. Winning the prize is subject to meeting all the requirements set out in these terms and conditions.

 

4.     VALIDITY OF THE PROMOTION

The promotion will be valid from 01 october at 09 AM (UCT+1) to 31 october at 02 PM (UCT+1), both inclusive.

The Catalan Tourist Board reserves the right to extend the promotion’s end date by announcing it on the entry website.

 

5.     DESCRIPTION OF THE PRIZE

The prize includes:

Winner resident in Catalonia

2 days (1 night)

1 meal (lunch or dinner) at the Disfrutar Restaurant in Barcelona – for 2 people

Winner resident in the rest of Spain

2 days (1 night)

Train/bus or plane ticket (round trip) for 2 people.

1 night in a hotel (4 stars) on a bed and breakfast basis for 2 people.

1 meal (lunch or dinner) at the Disfrutar Restaurant in Barcelona – for 2 people

Transport for the winner and a companion from the airport or train/bus station closest to the winner’s town or city of residence to Barcelona; and transport from Barcelona airport or a Barcelona train station back to the hometown or city.

The Catalan Tourist Board will choose the means of transport based on the winner’s town or city of residence.

Winner resident outside Spain

3 days (2 nights).

Train or plane ticket (round trip) for 2 people.

2 nights in a hotel (4 stars) on a bed and breakfast basis for 2 people.

1 meal (lunch or dinner) at the Disfrutar Restaurant in Barcelona – for 2 people

Transport for the winner and a companion from the airport or train station closest to the winner’s town or city of residence to Barcelona; and transport back to the home town or city.

The Catalan Tourist Board will choose the means of transport based on the winner’s town or city of residence.

Important: If the winner is not resident in Europe, they will have to choose a European town or city with a direct air or rail connection to Barcelona.

Only transport from a European town or city is included in the prize.

The schedule of the prize may be subject to change due to reasons beyond the Catalan Tourist Board’s control. In no case will this mean a reduction in its content.

Not included in the prize:

The prize does not include any expenses other than those mentioned above, such as travel from home to the airport or train/bus station in the country of origin, transfers from the airport or train/bus station to the hotel and from the hotel to the airport or train/bus station, meals other than those specified in the prize description, or any other additional expenses not stipulated in the prize.

The value of the prize will depend on the winner’s place of residence and will be at most as shown in the table below:

Dates when the prize can be redeemed:

The prize can be redeemed until 31 December 2026.

The prize must be redeemed on weekdays (the Disfrutar Restaurant is closed at the weekend) and the exact date to redeem the prize will be subject to the availability of the Disfrutar Restaurant within this time slot.

If the winner fails to show up at the restaurant, hotel or for transport, no change or alternative booking will be made.

The Catalan Tourist Board and any partner companies of this promotion will in no case be liable for any kind of direct, indirect and/or circumstantial damage or injury, whether immediate or delayed, which might occur on the occasion of or as a consequence of the prize and/or draw. Entry in this draw entails express acceptance of this condition.

The prize in this draw is subject to obligations under tax regulations which include payments on account as applicable in each case. The Catalan Tourist Board will ask the winners for proof of their tax residence before they redeem the prize and will issue a certificate stating the final value of the prize.

The prize in this draw is subject to statutory tax obligations and withholdings.

Under no circumstances may the prize be exchanged for its cash value.

 

6.     ENTRY IN THE DRAW

People who wish to enter the draw have to fill in the form at https://www.catalunya.com/en/disfrutar-experience including their personal data.

Entrants will receive confirmation of their entry via the same entry website.

Each entrant will be assigned an identifier code to be used in the draw.

Only one entry in the draw per person is allowed.

Entries will not be accumulated due to registering more than once.

Any fraud or attempted fraud, in particular provision of incorrect information or falsification of an address or identity, breach of these terms and conditions or any endeavour to disrupt the running of the draw, will result in the automatic exclusion of the entrant(s) involved and may entail legal action by the promoter.

Any winner who disrupts the running of the draw in any of the ways described above will forfeit the right to redeem their prize. All entrants, and in particular the winner, expressly accept and agree to any actions taken to confirm their identity. Any illegibility, inconsistency or falsehood in the entrant’s identity or address will result in their entry being automatically excluded and any prize won will be forfeited.

 

7.     HOW THE DRAW WORKS AND PRIZE NOTIFICATION

The draw will take place within at most 20 working days from the last date of entry in the promotion among all entrants who have filled in their personal data in accordance with these terms and conditions.

The draw will be held via the Easypromos platform using the procedure set out here.

The draw will have one winner and two alternates.

The result of the draw will be notified to the winner within at most 5 working days at the email address provided in the form. The winner has 3 working days from receipt of the prize notification email in which to accept the prize. This acceptance has to be reported to the promoter using the acceptance form given to them which they have to sign and email to info.discover@catalunya.com.

If due to circumstances beyond the control of the Catalan Tourist Board the winner cannot be contacted or does not accept the prize, they will be considered to have rejected it and the prize will be passed on to the first alternate who will also have 3 working days to accept it. This process will continue until there are no more alternates.

If neither the winner nor the alternates accept the prize, a new draw will be held with the rest of the entrants via the Easypromos platform using the procedure described in this section.

If this second draw also fails to produce a winner, the prize will not be awarded.

The Catalan Tourist Board is exempt from any liability arising from any errors in the data provided by the winners in the event that it is not possible to identify them.

Awarding the prize:

The prize will be awarded by the Catalan Tourist Board within at most one month from the date it is accepted by the winner. Travel and booking documents will be emailed to the winner.

The prize may only be awarded to the person named in the entry. Using and redeeming the prize are reserved for the person named in the winning entry and the person they specify as their companion. Under no circumstances may the winner of the prize transfer it to or exchange it with another person and it may not be offset in any other way.

The winner is only entitled to redeem the prize won as such and in no case may they ask for any financial consideration in return for waiving it.

 

8.      ACCEPTING THE TERMS AND CONDITIONS AND COMPLAINTS

Entry in the draw entails full acceptance of all the clauses in these terms and conditions and agreeing to abide by any decisions concerning their interpretation made by the Catalan Tourist Board as promoter of the draw.

Any complaints concerning this draw may be emailed to the Catalan Tourist Board at info.discover@catalunya.com within at most 30 days from the promotion’s end date.

 

9.     DATA PROTECTION

The Catalan Tourist Board is the controller for the processing of entrants’ data within the meaning of Article 26 of the General Data Protection Regulation.

The promoter will process data subjects’ personal data to manage their entry in the draw, administer the prize and tell them about any issues related to their entry. If the data subject opts in, their data may also be used to send marketing offers and newsletters related to tourism in Catalonia which the Catalan Tourist Board thinks may be of interest to them.

The winner and alternates in the draw are selected using the services of Easypromos, which operates as a processor. An agreement regulating its status as a processor is in place which authorises its access to these data for this purpose on behalf of the Catalan Tourist Board and excludes their use for any other purposes.

The promoter may retain the prize winners’ data to the extent necessary to comply with its legal obligations, perform its duties or safeguard its legitimate interests and in accordance with applicable data retention regulations.

Entrants may exercise their rights of access to their data, rectification, erasure, portability and restriction of and/or objection to processing by emailing the Data Protection Officer at lopd.act@gencat.cat. If you are not happy with our response when exercising your rights, you may make a complaint to the supervisory authority, namely the Catalan Data Protection Authority (www.apd.cat).

 

10.     IMAGE RIGHTS

The Catalan Tourist Board and any partner companies may with the winner’s consent reproduce and use their full name and other data and also their image in any advertising and/or promotional activities related to the draw which the winner has entered. Any use of this kind will not entitle the winner to any remuneration or benefit other than the prize they have won in the draw.

 

11.     LIABILITY

The Catalan Tourist Board does not accept any liability in the event of illness, accident or any other circumstance for which travel insurance is required. The winner therefore agrees to take out health and travel insurance before leaving their home country or town or city to cover their stay in Catalonia.

The Catalan Tourist Board declines any liability for any claim, loss, damage, cost or expense arising from injury, accident or death, damage, loss or delay of luggage or any other property, inconvenience, loss of remuneration, danger or disappointment, whether physical or mental, resulting from but not limited to: (1) mechanical breakdowns, government actions, strikes, forced closures due to war, weather, force majeure, terrorism or other factors beyond our control; (2) vandalism, air, land or sea piracy, theft, accidents, fire, injury, assault or any other physical damage to your property and/or injury to your person; and (3) your failure to follow instructions, including those relating to passports and visas.

 

12.     APPLICABLE LAW AND JURISDICTION.

These terms and conditions are governed by Spanish law.

Any disputes concerning the validity, interpretation and/or application of these terms and conditions will be submitted to the courts for the place of performance of the obligation, which is the place where the prize is redeemed.
