Initial Parking PCN

Just looking for some advice. I’ve read the newbies post but I am unsure of the next step. I will detail out the case to make it clear. 


Alleged contravention: 20 August

First letter / PCN date: 26 August

Only received PCN on 23 September — royal mail deliveries in my area are really bad 


Paid for 2 hours parking, was in car parking for 124 minutes, so 4 minutes over this time. 


Sent off appeal by email and post on 29/09 as follows. 


This notice is invalid and must be cancelled for the following reasons:

 

  1. Non-compliance with the Protection of Freedoms Act 2012 (PoFA)
    The alleged event was on 20 August 2025. Your Notice to Keeper is dated 26 August 2025, and it was not delivered until 23 September 2025. PoFA Schedule 4 requires delivery within 14 days. You have therefore failed to establish keeper liability.
  2. Grace Period – BPA Code of Practice
    Your own evidence alleges an overstay of just 4 minutes. The BPA Code of Practice requires a minimum 10 minutes’ grace period after parking ends. The alleged duration is well within this allowance.
  3. Unreliable ANPR evidence
    The photographs supplied with the PCN show no time or date stamps on the images themselves. I put you to strict proof that the ANPR system is synchronised, accurate, and audited in line with BPA requirements.
  4. No evidence of landowner authority
    You have not shown that you have authority from the landowner to issue or enforce parking charges at this site. I put you to strict proof of such authority.

 

 

This appeal is made by the registered keeper only. There is no admission as to the identity of the driver, and you must not assume otherwise.

 

I require you to cancel this charge immediately. If you refuse, you must issue a POPLA code so that I can escalate the matter.



They’ve replied to my email today saying its been referred to a debtor collector. 

I’ve read posts #2 and #4 but I’m just confused so I apologise for asking this when it is laid out. 

Happy to provide redacted parking charge notice letter. 

Do we ignore the debt collector?

    It would appear that the appeal was made after the appeal window closed 

    Definitely ignore the powerless debt collectors letters 

    Complain to the complaint link on the BPA AOS members list to Initial specifically regarding the breach of the Grace period and relevant section, stating that you require them to cancel this erroneous PCN , or you will subsequently complain about it to the BPA AOS compliance team on the BPA website  ( kick up a fuss  )

    Do so if the pcn is not cancelled 

    A plan A complaint to the landowner should be made too  ( kick up a fuss  )

    No backing down here,  raise the complaints

    Trying to rebump this for help if possible please. 

    appeal failed as it was after the ‘appeal time’. They didnt respond to my letter but did respond to my email, both the same appeal. 
    No luck with land owner as i cant find who owns the car park. 

    Getting letters from debt collectors now. 

    Unsure on next steps

    Ignore debt collector letters; do what was suggested by @Gr1pr; wait for claim form and that is where you will win - in court.  Follow this advice frequently posted by @Umkomaas
    SOME IDEAS ON DETERMINING WHO OWNS THE LAND 

    1. Google searches
    2. If a retail park, check on any signage which lists the on-site outlets
    3. Ask retailers on the site if there is a managing agent
    4. Ask retailers on the site to whom do they pay rent
    5. Contact the local authority and ask who pays the non-domestic/business rate for the car park (some councils have a spreadsheet on their website)
    6. Contact the local Valuation Office and ask if they know. They often have a website which might provide the information 
    7. Contact The Land Registry and for around £7 they should be able to provide definitive detail
    8. If you haven't already done so, give us the name of the car park/site/location, we may have seen other cases there.
