The Consumer Rights Act attempts to be fair to both parties. S23, the right to repair or replacement, says that once the consumer has agreed to the repair, they cannot exercise the right to reject without giving the trader a reasonable time to repair them (unless giving the trader that time would cause significant inconvenience to the consumer).
'Reasonable time' and 'significant inconvenience' are questions of fact.
The dealer seems to be doing all they can to get a brand new diff as soon as possible so that is probably reasonable.
Traders provide loan cars to reduce inconvenience. 'Significant inconvenience' is quite a high bar; not having heated seats for instance would not qualify (although my daughter would not agree). It would need to be something like if the courtesy car could not accommodate a powered wheelchair needed by the OP's spouse.0 -
update
received my first call yesterday 30/09/25 from motonovo asking me about about my problem, he mentioned that because the dealer is repairing the car he will uphold my claim.
he said he would call me again within the next few days.
01/10/25 receive another call from motonovo
long story short they only want to pay me back
£568 1 monthly payment
£210 mercedes check
£150 goodwill payment
in total i think around £944, I've asked them to cover the costs of £1881 car hire included in these costs.
they wont pay me the car hire costs because when i first put the complaint in with them their first email reply was, to not hire a car or take the broken car to another dealership to be looked at or fixed.
before i hired a car i spoke to motonovo over the phone asking for help and also stated that i would need to hire a car if they cant give me a courtesy car, the agent only said she understood and to email the invoices to them.
should i rejected the offer of £944 because none of this has even been my fault, what their basically giving me is £150 for all the drama I've had to enjoy.
now looking to take to the Financial ombudsman, if it takes months so be it.
