    Send the letter I posted last year, otherwise you might get a claim form to deal with, it would be best to nip this in the bud now.

    OK i will do that then. Thanks for the advice.

    Before i send it @sourcrates could they use the fact that me sending the letter is acknowledging the debt? Just a thought. I presume they will know themselves the exact timings, but again i am not sure whether they do. I will find a printing service and send it soon, no idea what happened to my own printer. I'll send it recorded too.

    If i have problems getting this letter printed would you entertain sending the letter as an attachment to the Email address on the letter? Mind you, that may not be a good idea, giving away my Email address.

    Actually found a service online that prints and sends correspondence. I will send the letter recorded to the their London registered office instead of the PO Box in Scotland that is quoted on the letter.

    @sourcrates this is what i will be sending a slight tweak if it suitable ;

    Dear PRA Group,

    I refer to your recent letter with your reference number: XYZ123

    Without Prejudice.

    "An action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".

    This debt was last acknowledged by payment in November 2018, and would have defaulted within guidelines some 3 to 6 months later meaning this debt defaulted before July 2019, over 7 years ago.

    The debt is therefore statute barred under section 5, limitation act 1980 and I will not be paying it.

    Please update your records accordingly and only contact me again to confirm this matter is now closed.

    Yours sincerely

    Send it by carrier pigeon if you want lol.

    They may try and make an argument that you are acknowledging the debt with this letter, as honestly you would not believe how incompetent some of these companies are, they may try to say the default date was later than that, but possibly they won`t have access to that information, they don`t know diddly squat about the accounts they purchase, unless that info is included.

    With the threat of possible legal action, you could wait until they actually do that, if they do, as per fatbelly`s advice, most of the time its just a bluff to get you to contact them, or send it now if you are certain of your position.

    Remember everything they send you is cleverly designed to invoke a response from you.

    @sourcrates i have sent it now recorded to their registered office. I was apprehensive but it is done now.
    So if they dont let up is it. Signed copy of the CA ? is that a thing ? Proof of purchase and when? Statement of account, last payments etc? It defaulted around June 2019, seven years ago now and is long gone from my credit file.

    Being statute barred should end this matter in your favour, the only way they can counter that is by taking you to court and testing it there, you should have a full defence, it would then be for the court to decide who is right and who is wrong.

    I would stick to this strategy now, as anything else just complicates matter more.

    Looks like someone objected to my letter being sent or maybe its a sign ! I got this Email earlier.
    I checked and double checked the Letter before uploading it. Also this company needs to use the billing address / account holder and NOT the intended letter recipient in the above Email - my god. I half expect the letter to also have been sent !!!!!

    This was it with better formatting and layout this is just a copy paste ;

    So right now, i have to assume no letter was sent and we are in that PRA 30 day countdown. I'm tempted to just wait for the next letter now then react and spring into action on the next letter.

    NB. I have not asked for proof from PRA as yet, eg, a signed copy of the CA etc or statement of account, last payment details etc. They must know its statute barred surely? They must know last payment was Nov 2018 right?

    I sent the Email;
    Thanks for the help and advice with this. I have just had an Email with the following;

    Dear ,

    Thanks for your email.

    I can confirm account XYZ has now been closed on our system. This means collections have ceased and we will no longer contact you to discuss matters further.

    If you have any further questions, please do not hesitate to get in touch.

    Kind Regards,
