Will made years ago help

I made a will when my only child was 3 years old, leaving all to him, he is now in his fifties, I was a single mum and I’m still a single mum,
The executors where my parent who have now both died.

As I’m still wanting all to go to my son, which will be a small house with no mortgage, is this will still ok when I die.

    the will would still be valid - presume your son would administer the estate and apply for letters of administration with will annexed as the executors name had died. 

    Other option is to get it redone - also consider what you might want to happen if he predeceased you - does he have children? Do you have other children?
  • I would be inclined to make a new will with your son as executor, if he willing and able to do the job.  If your estate is straightforward there would be little point in paying someone else.

    Alternatively a simple codicil to your will replacing your parents with your son as executor of your Will is possible.

    However, with over 50 years having elapsed since making your last will, I would think a review of his and your circumstances is long overdue and a new will drafted to reflect yours and his wishes going forward.

    A good opportunity for you and he to sit down with a solicitor and have a open dialogue.

    Did your will make any provision for your son predeceasing you ?   If no then it's time for a new will.

    This could be a good time to get a new Will drawn up as October is one of the Free Wills months, so if you can find a solicitor that's taking part you could get your Will at no cost - although even if you have to pay it should only be around £200, which I'd say would be money well spent.

    Good time to also discuss powers of attorney with him.  Better prepared than not!!  And please check out the online info on them - you don't need a solicitor to do these.

    Whilst I don't disagree that a codicil.is possible, we live in a world where word processors exist and hence codicils are generally an anachronism.  Anyone competent to produce a codicil and get it correctly signed is almost certainty competent to re-type a will, changing one name, and get it correctly signed.

    I do however agree that given the age of the will, getting a fresh one produced by a solicitor is almost certainly a good idea.

    If anything, they're likely to add to the risk of creating something which is contradictory or leaves gaps.
