Fine from PMavin Appeal Lost - Now POPLA?

Hey all wanted to get an opinion on my moving forward to appeal with POPLA.

So parking fine and I understand the fault is mine technically, but it seems to unfair but technically they are right, so heres the just of my appeal, which included all supporting evidence of parking history and patterns, intention to park that day (receipts)

"I am a regular user of this parking location and typically book parking weekly from 8:00 AM to 3:00 PM, provided evidenced by my past bookings. (I’ve about a year os using this site, this pattern)

On 19 August, I had a valid booking for parking from 8:00 AM to 10:00 AM only. This was an unintentional deviation from my usual booking pattern.

I left the parking space before 3:00 PM, which is my usual exit time, but after my booked time ended at 10:00 AM.

This was my first mistake in parking here, and I have always complied with the booking requirements on previous occasions."


They said no.

"Unfortunately, by failing to make a payment that covers your parking session in its entirety, and subsequently failing to attempt to make this payment after exiting the car park by contacting YourParkingSpace, you have not adhered to the terms and conditions of the car park and remain liable for the Parking Charge.

In addition, we compared the payment you made with the number of hours you parked, as per the booking site and the parking tariff, and found that they do not match.

Your vehicle was parked from 20/08/2025 08:54 to 20/08/2025 14:37 (5 hours, 42 minutes) , but you only booked from 20/08/2025 08:00 to 20/08/2025 10:00 (2 hours, 0 minutes) for your parking session, which resulted in a ParkingCharge. Also, the correct tariff should be £12.00, but you only paid £5.00.

However, as we believe this was a genuine error rather than an intentional attempt to avoid the full payment, we have reduced the charge to £25.00 to cover the outstanding parking tariff and the administrative costs of issuing the Parking Charge."

 

So I had a couple of comments to this statement for clarity and wasn’tr part of my original appeal to them.

1. It is my responcability and this seems to be the crux of it, my mistake, my fault and I can’t get round this (ADHD is a bummer)
2. They comment I made no subsequent attempt to contact them to resolve.  This seems like the behaviours of someone that realised they made a mistake.  Hence no additional contact.  Still however I left within my usual patterned time, indicating my intentions for the day.

2. They make comment that I paid for two hours on that day but took my usual hours.  This happened because I use the website (yourparkingspaceDOTcoDOTuk/) when you add a second day it copies the parking time hours, doesn’t need adjustment.  That day I started to use the app, when you add a second day on the app default to two hours (I didn’t pick two hours), it doesn’t copy the previous days hours like the website.  This is how I got tripped up.
3.  They state ‘we believe this was a genuine error rather than an intentional attempt to avoid the full payment’.  They recognized this is in error so we’ll reduce the fine instead of understanding.

And its that last bit that annoys me.  They see the pattern, they recognizes it’s a mistake on my part but rules are rules, so give us money anyway.

Do i suck it up and pay the £25, whats my chances with all of the above to POPLA since technically they are within their parking rules.  Does just being a unfairly punished for a distracted mind go anywhere?

    You won't win at POPLA, so either pay £25 or ignore them and the £170 threatograms for years. Tell them if you move house because you must respond if ever a court claim arrives.

    I think if you were my relative, I'd advise them to pay the £25 'under protest' and tell ParkMaven that they have now lost your business forever, as you have found a council car park nearby not run by a member of the rogue private parking industry. Once bitten twice shy & you are now no longer their customer.

    Literally NEVER EVER choose a private car park. Find a council one.
