DCB Legal Smart Parking CCJ

Hi all, I’ve read a lot and still learning. In the summer I received a fine saying I owed £170 for an unpaid parking fine from August 2020, taking advice from here I ignored the first 2 letters asking for payment and did not respond. I was then sent the next level of court form and a claim form. I sent this to DCB Legal along with a letter stating my defence, I wasn’t the driver at the time, my dad was and he has now passed, they have always stated the car park was paid but for insufficient time, as it was 5 years ago and not me I have no idea, they have never sent proof of anything. I didn’t receive anything till this summer. 

Clearly I have gone wrong somewhere as I’ve now been sent an actual judgement for claimant letter.

I’ve started looking into the n244 form but the costs of that are similar to the ccj (£349)

I want to fight it as the injustice is unreal but unsure how to proceed other than the n244 option? Many thanks

    You sent it to the wrong people,  to the wrong address , to DCB Legal 

    You should have sent the completed defence to the CNBC in Northampton,  not to DCB Legal 

    Its either pay in full or try the £313 set aside,  and still have to fight the original claim,  if the set aside is granted,  probably losing the £313 due to your blunder 

    Sorry to tell you this, but it's a costly error on your part  ( we would have guided you through it for free   )

  • Thank you for the reply, if I pay in time will the ccj be set aside then? I hate the thought of them winning but I have a lot on already and don’t want the ccj causing issues further down the line

    Payment in full, promptly,  to DCB Legal,  means that they will inform the  CNBC that its been paid within the grace period,  in full, and the CCJ will actually be Expunged,  a legal expression  ( not set aside   )

    Its either pay in full for the CCJ to be expunged,   OR pay for a set aside,  you cannot do both
