Amazon - returns within 1st 12 months

I bought an air fryer from Amazon 10 months ago.  Worked fine until a few days ago, but now fan makes a howling noise and the oven does not work.   Amazon tell me to send it to the manufacturer, the manufacturer, Tower, say "Under the Consumer Rights Act of 2015, the first year of warranty on your appliance is the responsibility of the retailer where you made your purchase.  As you have confirmed your appliance is less than 12 months old, you are able to exercise your Consumer Rights and obtain a full resolution from this retailer."     A lot of messing on the Amazon website has got me nowhere other than a person who tells me they only deal with Amazon.com, not Amazon.co.uk.    Realistically "contacting " Amazon.co.uk on this is not possible. So my question:  *is Tower correct in saying Amazon is responsible for the first 12 months;  and   *how do I get Consumer Protection usefully engaged?

    Your consumer rights are solely with the retailer, i.e. Amazon, never the manufacturer. If Tower have a clause that says in the first 12 months the retailer is responsible, then that seems entirely reasonable.

    According to one random air fryer manual I picked off their site

    "This product is guaranteed for 12 months from the date of original purchase. If any defect arises due to faulty materials of workmanship, the faulty products must be returned to the place of purchase. Refund or replacement is at the discretion of the retailer. THE FOLLOWING CONDITIONS APPLY: The product must be returned to the retailer with proof of purchase or a receipt."

    Not forgetting that as item is over 6 months old, that a independent is required to prove inherent fault.

    Was this purchased direct from Amazon or via a marketplace seller?

  • Thanks for your comments. I have no doubt that Amazon, as retailer, is responsible. My problem is that there is no way to engage with them - and I have tried and tried; you can only tick boxes and read FAQ's.  My question is how to get a third party  - consumer protection  - involved?
