Additional stamp duty

I am slightly confused as to whether I have unnecessarily paid the SDLT  surcharge on my property. 5 years ago I sold my main residence after my divorce and have been renting a property. I own a second home that has always been a secondary residence. I purchased a new main residence this year and have paid the surcharge but I'm now wondering if this was unnecessary given that I never made my secondary home my main residence. Has anyone else had this issue?

    From what you say it sounds entirely right that you paid the extra SDLT for additional properties when you bought this year.  It seems that was well over three years after you sold your previous home.

    No-one cares which property you call your main residence and which is your secondary residence.  If you already own a property and buy another one (without selling first) then the SDLT surcharge is payable.

    You’ve increased the number of houses you own, so the surcharge is due. Doesn’t matter which of them (if any) you live in.

    To exempt from the extra  charge you needed to buy your new house within 3 years of selling the previous one. 

    After 5 years you are no longer  considered to be  replacing your main residence
