    I note at the bottom of this the contract was signed on the 1/10/2024. This is  3 weeks after my PCN notice
    Yep, very relevant. Say something like "The Claimant provided what it purports to be a contract with the landowner, but it was signed and dated on 1/10/24, some 3 weeks after the parking event. It also refers to a site plan which was not supplied. InstaVolt Ltd's contractual relationship in the situation is also unknown ie. whether they lease or own the land, and whether the Claimant has any rights at all to operate on land occupied by a third party.

    I have received a hearing letter from my local court with a date set for the 2nd April. Im hoping to get my witness statement together with evidence which will include the site photos I took earlier (shown above).

    Im assuming I can just email this across to my local court and CC in DCB Legal and parkmaven. I was hoping to mention some bits about the landowner's contract being signed after my apparent incident, but do I just file this as part of my evidence, additionally do I submit the photos and contract that I will rely upon as evidence and send this to DCB as well.

    Just Email the court and DCB LEGAL, not Parkmaven

    Submit your Witness Statement plus Exhibits, so photos, court cases, everything, plus whatever is mentioned in the 2nd post in the newbies sticky thread in announcements , so the full monte ! No stone unturned

    Keep it under 50 pages, submitted as a pdf

    As the Claim was dated 4th September I'm assuming it carried the name Sarah Ensall on the back of it?

    Read the NEWBIES FAQS thread which is the one telling you 'what happens when' under a red capitals sub-heading.

    That is your stage. Read that first.

    • Was the name who signed it off on the back, Sarah Ensall? This is important. If yes, you can easily adapt the WS in the thread by @Horizon_Dawn which is a simple one responding to the claim, citing HHJ Moloney in Beavis and it has Mazur v Speechlys (the latter case law is only relevant for claims from Sarah Ensall).

    Read the 2nd post of the NEWBIES FAQS thread first. The bit about WS and exhibits where I give a lonnnggg list for defendants to use as evidence. Of course you exhibit your photos and the contract that was signed 3 weeks after the event but there's more.

    Yes it is signed Sarah Ensall. I will have a look as the WS by @Horizon_Dawn to see if this can be adapted to suit.
