Cancelled Contract

Hi new here but seeking any advice please. Poor service from boiler service/repair company. Had issues with old boiler the recommended i had a new one so did. Continued to have same issues with new boiler as with previous one. Back and forth without successful outcome. Advised them I was cancelling due to poor service. Now a year later they want to take me to court for outstanding fees. Thank you

    You need to explain exactly what you cancelled?
    Yes, considerably more detail needed - if they recommended an expensive fix to a problem and it failed to address it then they should be held accountable for that, but presumably OP will have tried that before deciding that cancelling some sort of contract was appropriate.

    Sorry, I had a service agreement for boiler.  upon visiting a few times with same issue (condensation pipe blockage) they recommended a new boiler as old one was 10 years.  So we took their recommendation and had a new boiler fitted. A few weeks later we had same issue (condensation pipe blockage), so did we need a new boiler we queried this but they eventually fixed it and then we had summer. Turned back in the October 2024, shortly after again same issue, came out twice fumbled with the boiler worked for a while then stopped with same issue.  Got fed up with them got a Gas Engineer (independent) to come within the hour the blockage was sorted and since then no problems.  I cancelled our contract after telling them first i was not happy, felt i had been miss sold a boiler for one and that they had not been able to sort the issue after many visits. Almost a year later they are trying to taking us to court for loss of fees.  Any advise welcome thank you

    What didnt you pay them for? Fitting the new boiler? Call outs? Cancelling the service agreement without due notice?

    I paid in cash for the boiler, the contract is for the servicing of the boiler etc., they had notice i emailed them and spoke to them. they seeking the fees for the break in contract which should have lasted for a number of years however, they could not provide the service at the time

    Was the contract for a specified duration or did it renew from year to year?

    What did the contract say about cancellation?  (Both by you and them)

    Did you give them the required notice of cancellation?

    morning, the contract is for 10 years.  I cannot find my email i sent to them to instruct them of the cancellation, which i did and i also spoke to them.  their cancellation period is 30 days, which i am pretty sure i provided. More to the point is that i had same issue throughout which they made still didn't fix, only made minor changes so we could get by for a period of time.
