APCOA Heathrow T5 appeal outcome help please

Hello all,

In a bit of a pickle here and could do with some advice please.

A PCN was received by the lease vehicle company as NtK from APCOA. They then sent the letter to the company who has hire of the car the PCN attached along with the transfer of liability letter. It claimed the authority (APCOA) would contact the hire company.

The hiring company went ahead of made an appeal on the APCOA site using the templates from here as a Hirer of the vehicle. No driver has been named. 

Whilst it was still under appeal APCOA sent another letter to the NtK. Who sent it to the hirer again.

APCOA still haven't sent a NtH letter to the hiring company.

Today APCOA have looked at the appeal and said the name on the appeal does not match the Registered Keeper details. 


As the hirer of the vehicle I'm not sure what to do now. Do I just sit tight and await another letter from the registered keepers, or wait for APCOA  to send out a NtH. Or do half of what APCOA asked, and reply that they have been sent the transfer of liability letter from the RK a month ago. And still refuse the driver of course. And entire company could drive this car.

    The hire/lease company must officially notify APCOA that you (with your name and address) are the hirer (lessee) of the vehicle.  The process for doing that is shown on the reverse page of the Notice to Keeper (NtK) that the hire company has received. 

    Then APCOA will need to send a Notice to Hirer (NtH) to you, thereafter you use the template appeal and receive the cancellation in due course. 

    Alternatively, you can just ignore it, APCOA will do nothing other than refer it to debt collectors, who will send you lots of silly letters, but ultimately can do diddly squat. This could go on for some months. 

    So, two options, neither of which include you making any payment to APCOA or to debt collectors. NO PAYING!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Send them a COMPLAINT (separate page than appeals) attaching the letter from the lease firm and tell APCOA that your firm has been named as hirer/lessee already.

    Tell them to send a NTH or a POPLA Code or cancel the PCN. That they have failed to send a Notice To Hirer yet is no-one except APCOA's fault but they cannot revert to the lease firm now as that would be unlawful.

    Looking at the original letter from the Lease firm (in this case Audi) -
    the APCOA contravention is dated 13/08/2025 in the am. 
    The PCN date of issue is dated 22/08/2025
    And the lease company's dated letter is 28/08/2025


    The letter from the lease firm said to appeal on the website  within 28 days of the time the notice was issued. Which was done 1st Sept 2025. stating "other", and that the appeal from the Registered Hirer.

    The letter also said the authority will contact the Hirer directly. But it seemed a bit ambiguous over whether or not to wait, or to appeal given the time frame. So an appeal was done online. Then of course the new letter arrived today.


    APCOA have already re-sent the PCN to the lease company after they should have received the transfer, during the appeal period, because the Lease company sent it to the lessee (who is not happy, and I have asked them to ignore future correspondence). 



    I think I'll go for the 2nd option, to save getting into bother by the company management. And hopefully get this binned, or a POPLA code. 



    Is there a template for the Complaint I can use please? I don't want to trip up  on  my words and be incorrect.

    Is this via the BPA site online complaints page? Or is it direct to APCOA? I can only see an email method to complain to APCOA.
