Train Station Parking Complaint

Good afternoon experts. Im
hoping you can provide some guidance. 

Background

earlier this year the driver of the vehicle I’m the RK for parked at a train station managed by national car parks. When parking at 07:00 the driver forgot to pay, and realised later that day (12:00). When notified I logged into RingGo and immediately paid for parking. 

What I failed to realise was that 07:00 is during peak pricing and when I paid was off-peak pricing. I hadn’t appreciated this as rushed to pay and didn’t read the in-app peak/off-peak pricing


I genuinely thought I had paid for the full day and when checking the rail operators website they offer the ability to pay parking charges up to 04:00 the following day so thought all was well.


What doesn’t help is that during this period I changed address and must not have yet updated my v5c so any communications have been issued to my prior address. 


I only know about this as I now have trace debt management on my case sending letters to my new address demanding payment of £170.


Current situation

After reading the newbies thread I have already emailed the DPO at NCP, the rail operator and Trace making a SAR and have instructed them to erase any previous address and update to my current address and am now looking to make a complaint to the rail operator under plan A as landowner but would appreciate some guidance on what I should include as there are only one or two success stories in the complaints thread related to rail operators.


  • Do I include details that I attempted to pay? I’m worried this could be used against me later 
  • Is there any value in stating ringgo doesn’t let you backdate the parking time


Or do I keep it vague, state payment was made and that it would be impossible to get a fair outcome from NCP highlighting I am a regular user of the car park and rail operator generally and have a history of good payment? Also talking to NCP making suitable attempts to trace me given no response to any letters that may have been sent (assuming they were sent to me given nothing has been received)

    You submit a formal complaint to NCP which they must also consider as an appeal. You simply tell them that you cannot be liable as the Keeper and you decline to identify the driver. As the location is not relevant land for the purpose of PoFA, they cannot progress this further and they should cancel the PCN.

    NCP are usually pragmatic about this and will usually cancel once they realise you know that you are untouchable as the Keeper.

    Then ignore them and ignore Trace. You will have seen the daft £170 letters in post 4 of the NEWBIES thread.
