Any one had a county court claim against them?

I have a county court claim issued against me.

I have been left in limbo as the issue in relation to the claim should have been paid by my insurance, I have an urgent case currently open with the ombudsman.

But before that gets resolved, its a ticking clock, should I acknowledge service to buy more time? If I do this an the ombudsman/insurer decides to pay up then what?

Also this appears to be a paper form, it says I can email my response in - should I or post it back? The deadline is next Tuesday.

    What exactly has your insurer said so far?
    Normally the advice would be to call your insurer, give them the details and let them deal with it, but it sounds as though it might not be that simple?

    If they pay up then that settles the claim. But if you're insured then you should in any event be passing it to your insurers and let them respond.

    Thanks - I have passed to insurers who did nothing hence the case with the ombudsman.

    Are you sure the deadline is Tuesday?

    The claim form should show the issue date

    Add 5 days to that to get the service date

    Add another 14 days to get to your deadline date

    You can postpone this for a further 14 days by acknowledging service. We recommend that you do this online if mcol is being used

    It doesn't work if you start on gov.uk

    If you do nothing you will get a ccj in default and the claimant will likely pass it to High Court Enforcement agent

    How to respond to a claim is set out on the Newbies thread on the parking board. You ask if it happens to anyone else and the answer from there is 'yes, all the time'

    You've given no context or details and so can only get very generic answers. 

    Ultimately insurers do at times make mistakes, they are ultimately staffed by humans who are fallible and certainly not helped that price has become king so operational costs are under pressure meaning staff are under pressure with everyone trying to do more with less. 

    I've certainly known cases where a judgement in default has occurred plus it's then not been paid. Without getting into a blame game the insurer has subsequently put its hand up to its errors and ultimately got it sorted. 

    The question really is why is the ombudsman involved? Its a fairly straightforward thing for the insurer to deal with and the involvement of the FOS suggests its not an operational issue but something more material
