Nexus taking me to court

I followed all the advice on the forum (I think) and I just got an email saying that they are proceeding with taking me to court. I really though from what everyone had said that they'd just drop it. I wish I'd paid it in the first place now!

Really stressed about this now. Why haven't they backed down like everyone said they would? What do I do now?

My husband was the one who overstayed at a services. He's a social worker and has meetings on teams and got a call while driving, and he just has no sense of time when he's working so he overstayed by 20mins.

Now he's really annoyed I didn't pay it originally as I said I'd handle it and we wouldn't end up going to court. I ignored the original letters and then I sent the defence on time and told him they'd back down.

    What exactly have you received?  Where exactly are you are in the court process?  Are DCB Legal involved?

  • They sent me court letter (after loads of threats) then I sent defence. Now they have sent this...

    Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim.

    In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.

    Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.

    If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.


    DCB legal are taking me court.

    Where you're at is a standard stage of the process. Hardly any cases are discontinued at this juncture.  Have you read the DCB Legal Discontinuation thread?  Just randomly select postings from it and you will see that your position now is where most posters have been, discontinuance following later.

    ..... and the date of issue of the claim form.  Hopefully the keeper (the one to whom the claim form was addressed) has completed and submitted the defence - on what date.  Check the 8 steps in the template defence thread to see where you are in the process.

    Can you also post a copy of the claim form redacted including VRM, password etc.  -  but leave all dates showing.

    Ps, they usually back down, with an N279 discontinuation document just before the hearing fee is due,  in several months time,  not before 

    So expect that discontinuation sometime next spring maybe 

    Meanwhile,  keep following the 8 steps in the defence template thread in announcements near the top of the forum by coupon mad 

    If you were not driving,  you have no legal liability,  so no need to worry 
  • OK, thanks for replies. Seems like I'm panicking too early. I've got a newborn so I'm struggling to get my head round all the steps. Chatgpt has helped with the steps too but I'm hoping it's giving the correct advice. I'll try and put aside some time to read through the thread again but toddler and newborn who won't sleep is making it difficult. 

    If I get chance I'll post the info asked for on here. 

    I'll try and do the survey too.
