Hi all
My wife has recieved a Claim Form from 2021, she cant remember much as was years ago. 
She has moved house a few times so must have been missing all the other warning letters n debt collectors letters etc. 
From what she does remember she was visiting a friend who was living in a flat within a controlled parking zone area with its own barrier. Her friend gave her a permitt to park, we just have no evidence to support this.
We need to write up a defence asap but looking for any help and advice on how to approach this case with so little to go on.

    Remove that picture ASAP and redact it correctly,  4 redactions required,  then repost

    Tell her to login to MCOL via her government gateway account and complete the AOS online on MCOL ASAP,  if not done already 

    Then draft her defence based on the template defence by coupon mad

    It's not her burden to evidence.

    It's theirs. And they won't.

    All she needs to do is follow the 8 steps in the Template Defence thread and DCB Legal will discontinue by 2026. They are not seeking people who defend. They want duped defendants who just pay up!

    Just editing the template defense to suit, does Paras 3.1 & 3.2 sound ok? Anything you could help improve on?

    The rest of the template iv kept the same, as i used back in June 2025

     

    3.1. The defendant parked at Phoenix House car park to visit a friend who lives in a Phoenix House flat on private land within a private parking area on and displayed a permit in there car whilst parked in their friends parking space. The permit used was given by the defendant’s friend who lived in the Phoenix House flats as used for flat owners visitors. The defendant had no reason to believe they had overstayed a free parking period as a visitor’s permit was displayed and permission was granted by the flat owner who has an allocated car park space with no time restrictions presented to  the defendant.

     

    3.2.  There is no 'legitimate interest' in pursuing a Defendant who had permission to park. There was no loss to the Claimant. The defendant had no reason to believe they had overstayed a free parking period because a visitor’s permit was displayed and permission was granted by the flat owner who has an allocated car park space with no time restrictions presented to  the defendant.

    Is this claim identical to the previous claim   ?

    Same parking company,  same location,  same facts , same defendant  etc  ?

    If it is then estoppel, Henderson vs Henderson spring to mind

    Not identical, mine was a no valid payment  claim.
    Different parking company Brittannia, but both dcb legal.
