Smart Parking Ltd - Appeal denied with evidence

Unfortunately I have to be subject to parking cowboys like this company. I went to park early morning to pickup milk and within 10 minutes left the parking. Then later that day I came back to park as I needed a few more items but left the parking within 20 minutes again. So this is a case of multi-entry and multi-exit however Smart Parking Ltd conveniently are missing the times inbetween and claiming I parked there for 5 hours. To note, I live 2 miles from the parking.

I submitted an appeal directly to smart parking showing with evidence that the vehicle left and returned to my house (CCTV footage) within the time frames equivalent to my actual parking time not their claimed time. Unfortunately they rejected my appeal and stated that I broke the terms of service and should still pay.

Now from my mind, a vehicle cannot exist in two places at once so if my evidence shows my vehicle leaving and arriving back home, then certainly that same vehicle cannot exist in their car park for 5 hours.

I have also checked the parking signs and no where does it mention that I cannot return within X amount of hours.

I 100% did not spend more than 30 minutes of total time in their parking and the parking clearly states 2 hours free parking with payment needed only for additional time over 2 hours. How do I get this to go away. I almost feel this is just fraud on their part. Attached their parking sign as proof of "no return" not existing and their free hours.

    I can't see what terms of service you have allegedly breached.  However I am aware that most car parking says "no return with x hours"
  • Just to note, there was 4 hours between visits. I have yet to see a parking that says no return within 4 hours. As for the T&C I can't see any other sign but I would have to go back their to to see if their is any fine print hidden away somewhere.
  • You are dealing with scammers in an unregulated industry, their business model includes ignoring appeals and trying to frighten people in to swelling their coffers.
    You have the proof of a double dip.
    The joint COP states:
    Page 19 of 57
    NOTE 1: The manual quality control check for remote ANPR and CCTV systems is
    particularly important for detecting issues such as “double dipping”, where image camera
    systems might have failed to accurately record each instance when a vehicle enters and
    leaves controlled land, and for checking images that might have been taken other than by
    a trained parking attendant (see Clause 15). The manual check might also reveal where
    “tailgating” – vehicles passing a camera close together – is a problem, suggesting
    relocation of the camera might be necessary.
    You could make a formal complaint to them stating they have not complied with their ATA's COP, but the slippery snakes will try to wriggle out of that.
    They would be stupid to try this in court with your evidence but that won't stop them threatening, don't let the dimwits intimidate you.

    The vast majority of private car parks don't include that term. It's fairly rare.

    This one doesn't have that term, so it is a clear ANPR flaw scam PCN. A double dip.

    Can't wait to see what the crappy IAS makes of this consumer's evidence. How will they wriggle out of this one... should be amusing.

    Put in an appeal to the IAS - call it out as a double dip and then please post the laughable outcome here:
