Horizon - Claim Form Recieved

Hello, The defendant parked into a retail car park shared by multple retailers. The defendant has dealt with defences before but just wants a second pair of eyes on paragraph 3. Is it too vague?

On [date], the Defendant parked at [location] while attending the gym and using both the gym facilities and swimming pool. As a legitimate customer and using the facilities for 16-18 months, the Defendant was entitled to use the car park. The car park signage referencing stay restrictions was not prominent, and the process for extending parking for gym users was unclear and inadequately signposted. The attempt to impose a penalty under these circumstances constitutes an unfair contract term.

The defendant did not use the extension machine as they were unaware they over stayed as it is was so minimal. The POC does not include any details apart from the breach itself.

Also, why do defendants not send emails anymore??

    Because the CNBC kept losing emails and people got CCJs unfairly. The CNBC's admin is so poor! Also it was time to make the defence more concise to please judges, some of whom were fed up with the long template. So it is now refreshed and fits in MCOL, protecting everyone from CCJ risk.

    Which solicitor firm? If it's Gladstones the D needs to use the Gladstones special on linked twice in the Template Defence thread.

    And are you SURE the PCN sum claimed matches the sum on the signs and PCN?

    Lots of Horizon ones this Summer don't state the right PC figure.
